66 AN ACT
77 relating to the requirement for parental consent for a minor to join
88 a labor union.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 101, Labor Code, is
1111 amended by adding Section 101.1175 to read as follows:
1212 Sec. 101.1175. PARENTAL CONSENT FOR MINORS. (a) In this
1313 section, "minor" means an individual younger than 18 years of age
1414 who has not had the disabilities of minority removed for general
1515 purposes under Chapter 31, Family Code.
1616 (b) Notwithstanding Section 101.001, a labor union may not
1717 accept a minor as a member unless the labor union obtains on a form
1818 provided by the Texas Workforce Commission the signed consent of
1919 the minor's parent, managing conservator, or guardian.
2020 SECTION 2. Not later than November 1, 2017, the Texas
2121 Workforce Commission shall develop the form required by Section
2222 101.1175, Labor Code, as added by this Act.
2323 SECTION 3. Section 101.1175, Labor Code, as added by this
2424 Act, applies only to a minor who applies to join a labor union on or
2525 after January 1, 2018. A minor who applies to join a labor union
2626 before that date is governed by the law in effect on the date the
2727 minor applies to join the labor union, and the former law is
2828 continued in effect for that purpose.
2929 SECTION 4. This Act takes effect September 1, 2017.
