| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Sections 407.126(a) and (b), Labor Code, are |
|---|
| 15 | 9 | | amended to read as follows: |
|---|
| 16 | 10 | | (a) Each member of the association shall be assessed an |
|---|
| 17 | 11 | | annual [a] fee, based on total amount of income benefits payments |
|---|
| 18 | 12 | | made in this state for the preceding reported calendar year, to |
|---|
| 19 | 13 | | maintain [create, over a period of 10 years beginning January 1, |
|---|
| 20 | 14 | | 1993,] a Texas certified self-insurer guaranty trust fund of at |
|---|
| 21 | 15 | | least $2 [$1] million for the emergency payment of the compensation |
|---|
| 22 | 16 | | liabilities of an impaired employer. The fund may not exceed three |
|---|
| 23 | 17 | | percent of the combined value of the security deposits of all |
|---|
| 24 | 18 | | certified self-insurers [$2 million]. |
|---|
| 25 | 19 | | (b) The board of directors shall submit to the commissioner |
|---|
| 26 | 20 | | for approval a recommended balance of the trust fund. On approval |
|---|
| 27 | 21 | | by the commissioner of the recommended balance, the board of |
|---|
| 28 | 22 | | directors shall adopt a year-by-year schedule of assessments to |
|---|
| 29 | 23 | | meet the [10-year] funding goal of the [trust] fund. |

| 30 | 24 | | SECTION 2. This Act takes effect September 1, 2017. |
