9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 442, Government Code, is |
---|
11 | 11 | | amended by adding Section 442.033 to read as follows: |

12 | 12 | | Sec. 442.033. TOM LEA TRAIL AS TEXAS HISTORIC HIGHWAY. (a) |

13 | 13 | | The commission shall cooperate with the Texas Department of |
---|
14 | 14 | | Transportation to designate, interpret, and market the following |
---|
15 | 15 | | segments of highway as the Tom Lea Trail and a Texas historic |
---|

80 | 80 | | (c) To supplement revenue available for the purposes under |

81 | 81 | | Subsection (a), the commission and the Texas Department of |
---|
82 | 82 | | Transportation may pursue federal funds dedicated to highway |
---|
83 | 83 | | enhancement. |
---|
84 | 84 | | (d) A designation of highway segments as the Tom Lea Trail |
---|
85 | 85 | | and a Texas historic highway may not be construed as a designation |
---|
86 | 86 | | under the National Historic Preservation Act (54 U.S.C. Section |
---|
87 | 87 | | 300101 et seq.). |
---|
88 | 88 | | (e) The Texas Department of Transportation is not required |
---|
89 | 89 | | to design, construct, or erect a marker under this section unless a |
---|
90 | 90 | | grant or donation of funds is made to the department to cover the |
---|
91 | 91 | | cost of the design, construction, and erection of the marker. Money |
---|
92 | 92 | | received to cover the cost of the marker shall be deposited to the |
---|
93 | 93 | | credit of the state highway fund. |
---|
94 | 94 | | SECTION 2. This Act takes effect September 1, 2017. |
