| 7 | 7 | | relating to the practice of chiropractic. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 201.002(b), Occupations Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (b) A person practices chiropractic under this chapter if |
|---|
| 12 | 12 | | the person: |
|---|
| 13 | 13 | | (1) uses objective or subjective means to analyze, |
|---|
| 14 | 14 | | diagnose, examine, or evaluate the biomechanical condition of the |
|---|
| 15 | 15 | | spine and musculoskeletal system of the human body; |
|---|
| 16 | 16 | | (2) performs nonsurgical, nonincisive procedures, |
|---|
| 17 | 17 | | including adjustment and manipulation, to improve the subluxation |
|---|
| 18 | 18 | | complex or the biomechanics of the musculoskeletal system; |
|---|
| 19 | 19 | | (3) represents to the public that the person is a |
|---|
| 20 | 20 | | chiropractor; or |
|---|
| 21 | 21 | | (4) uses the term "chiropractor," "chiropractic," |
|---|
| 22 | 22 | | "doctor of chiropractic," "D.C.," or any derivative of those terms |
|---|
| 23 | 23 | | or initials in connection with the person's name. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2017. |
