9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 81.091, Health and Safety Code, is | |
11 | 11 | amended by amending Subsection (a) and adding Subsection (a-1) to | |
12 | 12 | read as follows: | |
13 | 13 | (a) Except as provided by Subsection (a-1), a [A] physician, | |
14 | 14 | nurse, midwife, or other person in attendance at childbirth shall | |
15 | 15 | use or cause to be used prophylaxis approved by the executive | |
16 | 16 | commissioner to prevent ophthalmia neonatorum. | |
17 | 17 | (a-1) A physician, nurse, midwife, or other person in | |
18 | 18 | attendance at childbirth is not required to use or cause to be used | |
19 | 19 | the prophylaxis on an infant whose parent, managing conservator, or | |
20 | 20 | guardian does not consent to the administration of the prophylaxis. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2017. |
