66 AN ACT
77 relating to the consent required for the administration of
88 prophylaxis to prevent ophthalmia neonatorum.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 81.091, Health and Safety Code, is
1111 amended by amending Subsection (a) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) Except as provided by Subsection (a-1), a [A] physician,
1414 nurse, midwife, or other person in attendance at childbirth shall
1515 use or cause to be used prophylaxis approved by the executive
1616 commissioner to prevent ophthalmia neonatorum.
1717 (a-1) A physician, nurse, midwife, or other person in
1818 attendance at childbirth is not required to use or cause to be used
1919 the prophylaxis on an infant whose parent, managing conservator, or
2020 guardian does not consent to the administration of the prophylaxis.
2121 SECTION 2. This Act takes effect September 1, 2017.
