| 7 | 7 | | relating to license renewal for certain child-care facilities and |
|---|
| 8 | 8 | | registered family homes. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.048(f), Human Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (f) A license must be issued if the department determines |
|---|
| 13 | 13 | | that a facility meets all requirements. The evaluation shall be |
|---|
| 14 | 14 | | based on one or more visits to the facility and a review of required |
|---|
| 15 | 15 | | forms and records. A license is valid until [the license expires, |
|---|
| 16 | 16 | | is] revoked[,] or [is] surrendered. |
|---|
| 17 | 17 | | SECTION 2. Section 42.050, Human Resources Code, is amended |
|---|
| 18 | 18 | | to read as follows: |
|---|
| 19 | 19 | | Sec. 42.050. LICENSE RENEWAL. (a) A license holder may |
|---|
| 20 | 20 | | apply for [renewal of] a new license in compliance with the |
|---|
| 21 | 21 | | requirements of this chapter and department rules. |
|---|
| 22 | 22 | | (b) The application for [renewal of] a new license must be |
|---|
| 23 | 23 | | completed and decided on by the department before the expiration of |
|---|
| 24 | 24 | | the license under which a facility is operating. |
|---|
| 25 | 25 | | (c) The department shall evaluate the application for |
|---|
| 26 | 26 | | [renewal of] a new license to determine if all licensing |
|---|
| 27 | 27 | | requirements are met. The evaluation may include a specified |
|---|
| 28 | 28 | | number of visits to the facility and must include a review of all |
|---|
| 29 | 29 | | required forms and records. |
|---|
| 30 | 30 | | [(d) The executive commissioner shall adopt rules governing |
|---|
| 31 | 31 | | the license renewal process for all licenses issued under this |
|---|
| 32 | 32 | | chapter. The rules must include: |
|---|
| 33 | 33 | | [(1) renewal periods; |
|---|
| 34 | 34 | | [(2) a process for staggered renewals; |
|---|
| 35 | 35 | | [(3) a process for resolving a late application for |
|---|
| 36 | 36 | | renewal; |
|---|
| 37 | 37 | | [(4) expiration dates; and |
|---|
| 38 | 38 | | [(5) conditions for renewal.] |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2017. |
