97 relating to the new instructional facility allotment under the
108 foundation school program.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Sections 42.158(b), (d-1), and (g), Education
1311 Code, are amended to read as follows:
1412 (b) For the first school year in which students attend a new
1513 instructional facility, a school district is entitled to an
1614 allotment of $1,000 [$250] for each student in average daily
1715 attendance at the facility. For the second school year in which
1816 students attend that instructional facility, a school district is
1917 entitled to an allotment of $1,000 [$250] for each additional
2018 student in average daily attendance at the facility.
2119 (d-1) In addition to the appropriation amount described by
2220 Subsection (d), the amount of $1 million may be appropriated each
2321 school year to supplement the allotment to which a school district
2422 is entitled under this section that may be provided using the
2523 appropriation amount described by Subsection (d). The commissioner
2624 shall first apply the funds appropriated under this subsection to
2725 prevent any reduction under Subsection (d) in the allotment for
2826 attendance at an eligible high school instructional facility,
2927 subject to the maximum amount of $1,000 [$250] for each student in
3028 average daily attendance. Any funds remaining after preventing all
3129 reductions in amounts due for high school instructional facilities
3230 may be applied proportionally to all other eligible instructional
3331 facilities, subject to the maximum amount of $1,000 [$250] for each
3432 student in average daily attendance.
3533 (g) In this section:
3634 (1) "Instructional [, "instructional] facility" has
3735 the meaning assigned by Section 46.001.
3836 (2) "New instructional facility" includes:
3937 (A) a newly constructed instructional facility;
4038 (B) a repurposed instructional facility; and
4139 (C) a leased facility operating for the first
4240 time as an instructional facility with a minimum lease term of not
4341 less than 10 years.
4442 SECTION 2. A school district that is entitled under Section
4543 42.158, Education Code, to receive funding in the 2017-2018 school
4644 year for the second year of student attendance at a new
4745 instructional facility is entitled for that year to the amount
4846 provided for the second year of student attendance as a result of
4947 the changes in law made by this Act.
5048 SECTION 3. This Act takes effect September 1, 2017.
