9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 408.183(b), Labor Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | (b) An eligible spouse is entitled to receive death benefits | |
13 | 13 | for life, regardless of whether the spouse remarries [or until | |
14 | 14 | remarriage. On remarriage, the eligible spouse is entitled to | |
15 | 15 | receive 104 weeks of death benefits, commuted as provided by | |
16 | 16 | commissioner rule]. | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to a claim for workers' compensation benefits based on a | |
19 | 19 | compensable injury that occurs on or after the effective date of | |
20 | 20 | this Act. A claim based on a compensable injury that occurs before | |
21 | 21 | the effective date of this Act is governed by the law in effect on | |
22 | 22 | the date the compensable injury occurred, and the former law is | |
23 | 23 | continued in effect for that purpose. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2017. |
