55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to workers' compensation death benefit eligibility of
88 certain spouses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 408.183(b), Labor Code, is amended to
1111 read as follows:
1212 (b) An eligible spouse is entitled to receive death benefits
1313 for life, regardless of whether the spouse remarries [or until
1414 remarriage. On remarriage, the eligible spouse is entitled to
1515 receive 104 weeks of death benefits, commuted as provided by
1616 commissioner rule].
1717 SECTION 2. The change in law made by this Act applies only
1818 to a claim for workers' compensation benefits based on a
1919 compensable injury that occurs on or after the effective date of
2020 this Act. A claim based on a compensable injury that occurs before
2121 the effective date of this Act is governed by the law in effect on
2222 the date the compensable injury occurred, and the former law is
2323 continued in effect for that purpose.
2424 SECTION 3. This Act takes effect September 1, 2017.
