55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to liability of certain political subdivisions in certain
88 workers' compensation actions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 504.053(e), Labor Code, is amended to
1111 read as follows:
1212 (e) Nothing in this chapter waives sovereign immunity or
1313 creates a new cause of action, except that a political subdivision
1414 that self-insures either individually or collectively is liable for
1515 attorney's fees as provided by Section 417.003.
1616 SECTION 2. Section 504.053, Labor Code, as amended by this
1717 Act, applies only to a third-party action under Chapter 417, Labor
1818 Code, commenced on or after the effective date of this Act. A
1919 third-party action under Chapter 417, Labor Code, commenced before
2020 the effective date of this Act is governed by the law applicable to
2121 the action immediately before the effective date of this Act, and
2222 that law is continued in effect for that purpose.
2323 SECTION 3. This Act takes effect September 1, 2017.
