55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to preauthorization and concurrent review of certain
88 health care services under the workers' compensation system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 413.014, Labor Code, is amended by
1111 amending Subsection (c) and adding Subsection (c-1) to read as
1212 follows:
1313 (c) The commissioner's rules adopted under this section
1414 must provide that preauthorization and concurrent review are
1515 required at a minimum for:
1616 (1) spinal surgery, as provided by Section 408.026;
1717 (2) work-hardening or work-conditioning services
1818 [provided by a health care facility that is not credentialed by an
1919 organization recognized by commissioner rules];
2020 (3) inpatient hospitalization, including any
2121 procedure and length of stay;
2222 (4) physical and occupational therapy;
2323 (5) outpatient or ambulatory surgical services, as
2424 defined by commissioner rule; and
2525 (6) any investigational or experimental services or
2626 devices.
2727 (c-1) Notwithstanding Subsection (c)(2), the commissioner
2828 by rule may exempt from preauthorization and concurrent review
2929 work-hardening or work-conditioning services provided by a health
3030 care facility that is credentialed by an organization designated by
3131 commissioner rule.
3232 SECTION 2. The change in law made by this Act applies only
3333 to health care services provided on or after the effective date of
3434 this Act in conjunction with a claim for workers' compensation
3535 benefits, regardless of the date on which the compensable injury
3636 that is the basis of the claim occurred.
3737 SECTION 3. This Act takes effect September 1, 2017.
