7 | 7 | | relating to disclosures regarding the provision of laboratory |
---|
8 | 8 | | services in certain health care facilities. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 324.101(a), Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (a) Each facility shall develop, implement, and enforce |
---|
13 | 13 | | written policies for the billing of facility health care services |
---|
14 | 14 | | and supplies. The policies must address: |
---|
15 | 15 | | (1) any discounting of facility charges to an |
---|
16 | 16 | | uninsured consumer, subject to Chapter 552, Insurance Code; |
---|
17 | 17 | | (2) any discounting of facility charges provided to a |
---|
18 | 18 | | financially or medically indigent consumer who qualifies for |
---|
19 | 19 | | indigent services based on a sliding fee scale or a written charity |
---|
20 | 20 | | care policy established by the facility and the documented income |
---|
21 | 21 | | and other resources of the consumer; |
---|
22 | 22 | | (3) the providing of an itemized statement required by |
---|
23 | 23 | | Subsection (e); |
---|
24 | 24 | | (4) whether interest will be applied to any billed |
---|
25 | 25 | | service not covered by a third-party payor and the rate of any |
---|
26 | 26 | | interest charged; |
---|
27 | 27 | | (5) the procedure for handling complaints; |
---|
28 | 28 | | (6) the providing of a conspicuous written disclosure |
---|
29 | 29 | | to a consumer at the time the consumer is first admitted to the |
---|
30 | 30 | | facility or first receives services at the facility that: |
---|
31 | 31 | | (A) provides confirmation whether the facility |
---|
32 | 32 | | is a participating provider under the consumer's third-party payor |
---|
33 | 33 | | coverage on the date services are to be rendered based on the |
---|
34 | 34 | | information received from the consumer at the time the confirmation |
---|
35 | 35 | | is provided; |
---|
36 | 36 | | (B) informs the consumer [consumers] that a |
---|
37 | 37 | | facility-based physician who may provide services to the consumer |
---|
38 | 38 | | while the consumer is in the facility may not be a participating |
---|
39 | 39 | | provider with the same third-party payors as the facility; |
---|
40 | 40 | | (C) informs the consumer [consumers] that the |
---|
41 | 41 | | consumer may receive a bill for medical services from a |
---|
42 | 42 | | facility-based physician for the amount unpaid by the consumer's |
---|
43 | 43 | | health benefit plan; |
---|
44 | 44 | | (D) informs the consumer [consumers] that the |
---|
45 | 45 | | consumer may request a listing of facility-based physicians who |
---|
46 | 46 | | have been granted medical staff privileges to provide medical |
---|
47 | 47 | | services at the facility; [and] |
---|
48 | 48 | | (E) informs the consumer [consumers] that the |
---|
49 | 49 | | consumer may request information from a facility-based physician on |
---|
50 | 50 | | whether the physician has a contract with the consumer's health |
---|
51 | 51 | | benefit plan and under what circumstances the consumer may be |
---|
52 | 52 | | responsible for payment of any amounts not paid by the consumer's |
---|
53 | 53 | | health benefit plan; |
---|
54 | 54 | | (F) informs the consumer that laboratory |
---|
55 | 55 | | services related to the consumer's facility admission, stay, or |
---|
56 | 56 | | services may be provided by a laboratory that may not be a |
---|
57 | 57 | | participating provider with the same third-party payors as the |
---|
58 | 58 | | facility; and |
---|
59 | 59 | | (G) informs the consumer that the consumer may |
---|
60 | 60 | | request from the facility a list of the names and contact |
---|
61 | 61 | | information of the laboratories that typically provide laboratory |
---|
62 | 62 | | services for the facility; |
---|
63 | 63 | | (7) the requirement that a facility provide a list, on |
---|
64 | 64 | | request, to a consumer to be admitted to, or who is expected to |
---|
65 | 65 | | receive services from, the facility, that contains the name and |
---|
66 | 66 | | contact information for each facility-based physician or |
---|
67 | 67 | | facility-based physician group that has been granted medical staff |
---|
68 | 68 | | privileges to provide medical services at the facility; and |
---|
69 | 69 | | (8) if the facility operates a website that includes a |
---|
70 | 70 | | listing of physicians who have been granted medical staff |
---|
71 | 71 | | privileges to provide medical services at the facility, the posting |
---|
72 | 72 | | on the facility's website of a list that contains the name and |
---|
73 | 73 | | contact information for each facility-based physician or |
---|
74 | 74 | | facility-based physician group that has been granted medical staff |
---|
75 | 75 | | privileges to provide medical services at the facility and the |
---|
76 | 76 | | updating of the list in any calendar quarter in which there are any |
---|
77 | 77 | | changes to the list. |
---|
78 | 78 | | SECTION 2. The changes in law made by this Act apply only to |
---|
79 | 79 | | a disclosure provided to a consumer by a health care facility on or |
---|
80 | 80 | | after the effective date of this Act. |
---|
81 | 81 | | SECTION 3. This Act takes effect September 1, 2017. |
