7 | 7 | | relating to the guaranteed level of state and local funds for the |

8 | 8 | | instructional facilities allotment and the existing debt allotment |
---|
9 | 9 | | under the public school finance system. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Section 46.003, Education Code, is amended by |
---|
12 | 12 | | amending Subsection (a) and adding Subsections (a-1) and (a-2) to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (a) For each year, except as provided by Sections 46.005 and |
---|
15 | 15 | | 46.006, a school district is guaranteed a specified amount per |
---|
16 | 16 | | student in state and local funds for each cent of tax effort, up to |
---|
17 | 17 | | the maximum rate under Subsection (b), to pay the principal of and |
---|
18 | 18 | | interest on eligible bonds issued to construct, acquire, renovate, |
---|
19 | 19 | | or improve an instructional facility. The amount of state support |
---|
20 | 20 | | is determined by the formula: |
---|
21 | 21 | | FYA = (FYL X ADA X BTR X 100) - (BTR X (DPV/100)) |
---|
22 | 22 | | where: |
---|
23 | 23 | | "FYA" is the guaranteed facilities yield amount of state |
---|
24 | 24 | | funds allocated to the district for the year; |
---|
25 | 25 | | "FYL" is the dollar amount guaranteed level of state and |
---|
26 | 26 | | local funds per student per cent of tax effort, which is the amount |
---|
27 | 27 | | of district tax revenue per student in average daily attendance per |
---|
28 | 28 | | cent of tax effort available to a district at the 88th percentile in |
---|
29 | 29 | | wealth per student in average daily attendance, as determined by |
---|
30 | 30 | | the commissioner in cooperation with the Legislative Budget Board, |
---|
31 | 31 | | [$35] or a greater amount for any year provided by appropriation; |
---|
32 | 32 | | "ADA" is the greater of the number of students in average |
---|
33 | 33 | | daily attendance, as determined under Section 42.005, in the |
---|
34 | 34 | | district or 400; |
---|
35 | 35 | | "BTR" is the district's bond tax rate for the current year, |
---|
36 | 36 | | which is determined by dividing the amount budgeted by the district |
---|
37 | 37 | | for payment of eligible bonds by the quotient of the district's |
---|
38 | 38 | | taxable value of property as determined under Subchapter M, Chapter |
---|
39 | 39 | | 403, Government Code, or, if applicable, Section 42.2521, divided |
---|
40 | 40 | | by 100; and |
---|
41 | 41 | | "DPV" is the district's taxable value of property as |
---|
42 | 42 | | determined under Subchapter M, Chapter 403, Government Code, or, if |
---|
43 | 43 | | applicable, Section 42.2521. |
---|
44 | 44 | | (a-1) The percentile in wealth per student described by |
---|
45 | 45 | | Subsection (a) for purposes of determining the dollar amount |
---|
46 | 46 | | guaranteed level of state and local funds ("FYL") applies beginning |
---|
47 | 47 | | with the 2025-2026 school year. For the 2017-2018 through |
---|
48 | 48 | | 2024-2025 school years, "FYL" is determined as follows: |
---|
49 | 49 | | (1) for the 2017-2018 and 2018-2019 school years, |
---|
50 | 50 | | "FYL" is determined under Subsection (a) using the 52nd percentile |
---|
51 | 51 | | in wealth per student; |
---|
52 | 52 | | (2) for the 2019-2020 and 2020-2021 school years, |
---|
53 | 53 | | "FYL" is determined under Subsection (a) using the 61st percentile |
---|
54 | 54 | | in wealth per student; |
---|
55 | 55 | | (3) for the 2021-2022 and 2022-2023 school years, |
---|
56 | 56 | | "FYL" is determined under Subsection (a) using the 70th percentile |
---|
57 | 57 | | in wealth per student; and |
---|
58 | 58 | | (4) for the 2023-2024 and 2024-2025 school years, |
---|
59 | 59 | | "FYL" is determined under Subsection (a) using the 79th percentile |
---|
60 | 60 | | in wealth per student. |
---|
61 | 61 | | (a-2) Subsection (a-1) and this subsection expire September |
---|
62 | 62 | | 1, 2026. |

63 | 63 | | SECTION 2. Section 46.032, Education Code, is amended by |

64 | 64 | | amending Subsection (a) and adding Subsections (a-1) and (a-2) to |
---|

66 | 66 | | (a) Each school district is guaranteed a specified amount |

70 | 70 | | 46.034, is determined by the formula: |

71 | 71 | | EDA = (EDGL X ADA X EDTR X 100) - (EDTR X (DPV/100)) |
---|
72 | 72 | | where: |
---|
73 | 73 | | "EDA" is the amount of state funds to be allocated to the |
---|
74 | 74 | | district for assistance with existing debt; |
---|
75 | 75 | | "EDGL" is the dollar amount guaranteed level of state and |
---|
76 | 76 | | local funds per student per cent of tax effort, which is the amount |
---|
77 | 77 | | of district tax revenue per student in average daily attendance per |
---|
78 | 78 | | cent of tax effort available to a district at the 88th percentile in |
---|
79 | 79 | | wealth per student in average daily attendance, as determined by |
---|
80 | 80 | | the commissioner in cooperation with the Legislative Budget Board, |
---|
81 | 81 | | [$35] or a greater amount for any year provided by appropriation; |

99 | 99 | | "EDGL" is determined under Subsection (a) using the 52nd percentile |

101 | 101 | | (2) for the 2019-2020 and 2020-2021 school years, |
---|
102 | 102 | | "EDGL" is determined under Subsection (a) using the 61st percentile |
---|
103 | 103 | | in wealth per student; |
---|
104 | 104 | | (3) for the 2021-2022 and 2022-2023 school years, |
---|
105 | 105 | | "EDGL" is determined under Subsection (a) using the 70th percentile |
---|
106 | 106 | | in wealth per student; and |
---|
107 | 107 | | (4) for the 2023-2024 and 2024-2025 school years, |
---|
108 | 108 | | "EDGL" is determined under Subsection (a) using the 79th percentile |
