55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the guaranteed level of state and local funds for the
88 instructional facilities allotment and the existing debt allotment
99 under the public school finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 46.003, Education Code, is amended by
1212 amending Subsection (a) and adding Subsections (a-1) and (a-2) to
1313 read as follows:
1414 (a) For each year, except as provided by Sections 46.005 and
1515 46.006, a school district is guaranteed a specified amount per
1616 student in state and local funds for each cent of tax effort, up to
1717 the maximum rate under Subsection (b), to pay the principal of and
1818 interest on eligible bonds issued to construct, acquire, renovate,
1919 or improve an instructional facility. The amount of state support
2020 is determined by the formula:
2121 FYA = (FYL X ADA X BTR X 100) - (BTR X (DPV/100))
2222 where:
2323 "FYA" is the guaranteed facilities yield amount of state
2424 funds allocated to the district for the year;
2525 "FYL" is the dollar amount guaranteed level of state and
2626 local funds per student per cent of tax effort, which is the amount
2727 of district tax revenue per student in average daily attendance per
2828 cent of tax effort available to a district at the 88th percentile in
2929 wealth per student in average daily attendance, as determined by
3030 the commissioner in cooperation with the Legislative Budget Board,
3131 [$35] or a greater amount for any year provided by appropriation;
3232 "ADA" is the greater of the number of students in average
3333 daily attendance, as determined under Section 42.005, in the
3434 district or 400;
3535 "BTR" is the district's bond tax rate for the current year,
3636 which is determined by dividing the amount budgeted by the district
3737 for payment of eligible bonds by the quotient of the district's
3838 taxable value of property as determined under Subchapter M, Chapter
3939 403, Government Code, or, if applicable, Section 42.2521, divided
4040 by 100; and
4141 "DPV" is the district's taxable value of property as
4242 determined under Subchapter M, Chapter 403, Government Code, or, if
4343 applicable, Section 42.2521.
4444 (a-1) The percentile in wealth per student described by
4545 Subsection (a) for purposes of determining the dollar amount
4646 guaranteed level of state and local funds ("FYL") applies beginning
4747 with the 2025-2026 school year. For the 2017-2018 through
4848 2024-2025 school years, "FYL" is determined as follows:
4949 (1) for the 2017-2018 and 2018-2019 school years,
5050 "FYL" is determined under Subsection (a) using the 52nd percentile
5151 in wealth per student;
5252 (2) for the 2019-2020 and 2020-2021 school years,
5353 "FYL" is determined under Subsection (a) using the 61st percentile
5454 in wealth per student;
5555 (3) for the 2021-2022 and 2022-2023 school years,
5656 "FYL" is determined under Subsection (a) using the 70th percentile
5757 in wealth per student; and
5858 (4) for the 2023-2024 and 2024-2025 school years,
5959 "FYL" is determined under Subsection (a) using the 79th percentile
6060 in wealth per student.
6161 (a-2) Subsection (a-1) and this subsection expire September
6262 1, 2026.
6363 SECTION 2. Section 46.032, Education Code, is amended by
6464 amending Subsection (a) and adding Subsections (a-1) and (a-2) to
6565 read as follows:
6666 (a) Each school district is guaranteed a specified amount
6767 per student in state and local funds for each cent of tax effort to
6868 pay the principal of and interest on eligible bonds. The amount of
6969 state support, subject only to the maximum amount under Section
7070 46.034, is determined by the formula:
7171 EDA = (EDGL X ADA X EDTR X 100) - (EDTR X (DPV/100))
7272 where:
7373 "EDA" is the amount of state funds to be allocated to the
7474 district for assistance with existing debt;
7575 "EDGL" is the dollar amount guaranteed level of state and
7676 local funds per student per cent of tax effort, which is the amount
7777 of district tax revenue per student in average daily attendance per
7878 cent of tax effort available to a district at the 88th percentile in
7979 wealth per student in average daily attendance, as determined by
8080 the commissioner in cooperation with the Legislative Budget Board,
8181 [$35] or a greater amount for any year provided by appropriation;
8282 "ADA" is the number of students in average daily attendance,
8383 as determined under Section 42.005, in the district;
8484 "EDTR" is the existing debt tax rate of the district, which is
8585 determined by dividing the amount budgeted by the district for
8686 payment of eligible bonds by the quotient of the district's taxable
8787 value of property as determined under Subchapter M, Chapter 403,
8888 Government Code, or, if applicable, under Section 42.2521, divided
8989 by 100; and
9090 "DPV" is the district's taxable value of property as
9191 determined under Subchapter M, Chapter 403, Government Code, or, if
9292 applicable, under Section 42.2521.
9393 (a-1) The percentile in wealth per student described by
9494 Subsection (a) for purposes of determining the dollar amount
9595 guaranteed level of state and local funds ("EDGL") applies
9696 beginning with the 2025-2026 school year. For the 2017-2018
9797 through 2024-2025 school years, "EDGL" is determined as follows:
9898 (1) for the 2017-2018 and 2018-2019 school years,
9999 "EDGL" is determined under Subsection (a) using the 52nd percentile
100100 in wealth per student;
101101 (2) for the 2019-2020 and 2020-2021 school years,
102102 "EDGL" is determined under Subsection (a) using the 61st percentile
103103 in wealth per student;
104104 (3) for the 2021-2022 and 2022-2023 school years,
105105 "EDGL" is determined under Subsection (a) using the 70th percentile
106106 in wealth per student; and
107107 (4) for the 2023-2024 and 2024-2025 school years,
108108 "EDGL" is determined under Subsection (a) using the 79th percentile
109109 in wealth per student.
110110 (a-2) Subsection (a-1) and this subsection expire September
111111 1, 2026.
112112 SECTION 3. This Act takes effect September 1, 2017.
