99 relating to a prohibition of the land application of grease or grit
1010 trap waste.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 361.121(a)(2), Health and Safety Code,
1313 is amended to read as follows:
1414 (2) "Land application unit" means an area where wastes
1515 are applied onto or incorporated into the soil surface for
1616 agricultural purposes or for treatment and disposal. The term does
1717 not include manure spreading operations or placement of waste on a
1818 liner registered or permitted by the commission.
1919 SECTION 2. Subchapter C, Chapter 361, Health and Safety
2020 Code, is amended by adding Section 361.1215 to read as follows:
2121 Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP
2222 WASTE PROHIBITED. (a) In this section:
2323 (1) "Grease trap waste" means a material collected in
2424 and from a grease interceptor in the sanitary sewer line of a
2525 commercial, institutional, or industrial food service or
2626 processing facility. The term includes the solids resulting from a
2727 dewatering process.
2828 (2) "Grit trap" means a unit or chamber that:
2929 (A) allows the sedimentation of solids from an
3030 influent liquid stream by reducing the flow velocity of the stream;
3131 (B) has an inlet and outlet that are both located
3232 at the same vertical level at or near the top of the unit or chamber;
3333 (C) has an outlet that is connected to a sanitary
3434 sewer system; and
3535 (D) is not designed to separate oil and water.
3636 (3) "Grit trap waste" means the waste collected in a
3737 grit trap. The term includes waste from an interceptor placed in a
3838 drain at maintenance and repair shops, automobile service stations,
3939 car washes, laundries, and other similar facilities.
4040 (b) The commission may not issue a permit, registration, or
4141 other authorization for land application of grease trap waste or
4242 grit trap waste.
4343 (c) This section does not apply to:
4444 (1) the disposal of grease trap waste or grit trap
4545 waste at a municipal solid waste Type I landfill permitted by the
4646 commission;
4747 (2) the processing of grease trap waste or grit trap
4848 waste at a municipal solid waste Type V compost facility permitted
4949 or registered by the commission; or
5050 (3) land application of Grade 1 or Grade 2 compost
5151 generated at a Type V compost facility permitted to compost grease
5252 trap waste by the commission.
5353 SECTION 3. A permit, registration, or other authorization
5454 issued by the Texas Commission on Environmental Quality that allows
5555 the land application of grease trap waste or grit trap waste expires
5656 on the effective date of this Act. The remainder of a permit,
5757 registration, or other authorization that contains items in
5858 addition to an authorization allowing the land application of
5959 grease trap waste or grit trap waste remains in effect to the extent
6060 that it does not authorize the land application of grease trap waste
6161 or grit trap waste.
6262 SECTION 4. This Act takes effect immediately if it receives
6363 a vote of two-thirds of all the members elected to each house, as
6464 provided by Section 39, Article III, Texas Constitution. If this
6565 Act does not receive the vote necessary for immediate effect, this
6666 Act takes effect September 1, 2017.
