8	8	AN ACT
9	9	relating to a prohibition of the land application of grease or grit
10	10	trap waste.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 361.121(a)(2), Health and Safety Code,
13	13	is amended to read as follows:
14	14	(2) "Land application unit" means an area where wastes
15	15	are applied onto or incorporated into the soil surface for
16	16	agricultural purposes or for treatment and disposal. The term does
17	17	not include manure spreading operations or placement of waste on a
18	18	liner registered or permitted by the commission.
19	19	SECTION 2. Subchapter C, Chapter 361, Health and Safety
20	20	Code, is amended by adding Section 361.1215 to read as follows:
21	21	Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP
22	22	WASTE PROHIBITED. (a) In this section:
23	23	(1) "Grease trap waste" means a material collected in
24	24	and from a grease interceptor in the sanitary sewer line of a
25	25	commercial, institutional, or industrial food service or
26	26	processing facility. The term includes the solids resulting from a
27	27	dewatering process.
28	28	(2) "Grit trap" means a unit or chamber that:
29	29	(A) allows the sedimentation of solids from an
30	30	influent liquid stream by reducing the flow velocity of the stream;
31	31	(B) has an inlet and outlet that are both located
32	32	at the same vertical level at or near the top of the unit or chamber;
33	33	(C) has an outlet that is connected to a sanitary
34	34	sewer system; and
35	35	(D) is not designed to separate oil and water.
36	36	(3) "Grit trap waste" means the waste collected in a
37	37	grit trap. The term includes waste from an interceptor placed in a
38	38	drain at maintenance and repair shops, automobile service stations,
39	39	car washes, laundries, and other similar facilities.
40	40	(b) The commission may not issue a permit, registration, or
41	41	other authorization for land application of grease trap waste or
42	42	grit trap waste.
43	43	(c) This section does not apply to:
44	44	(1) the disposal of grease trap waste or grit trap
45	45	waste at a municipal solid waste Type I landfill permitted by the
46	46	commission;
47	47	(2) the processing of grease trap waste or grit trap
48	48	waste at a municipal solid waste Type V compost facility permitted
49	49	or registered by the commission; or
50	50	(3) land application of Grade 1 or Grade 2 compost
51	51	generated at a Type V compost facility permitted to compost grease
52	52	trap waste by the commission.
53	53	SECTION 3. A permit, registration, or other authorization
54	54	issued by the Texas Commission on Environmental Quality that allows
55	55	the land application of grease trap waste or grit trap waste expires
56	56	on the effective date of this Act. The remainder of a permit,
57	57	registration, or other authorization that contains items in
58	58	addition to an authorization allowing the land application of
59	59	grease trap waste or grit trap waste remains in effect to the extent
60	60	that it does not authorize the land application of grease trap waste
61	61	or grit trap waste.
62	62	SECTION 4. This Act takes effect immediately if it receives
63	63	a vote of two-thirds of all the members elected to each house, as
64	64	provided by Section 39, Article III, Texas Constitution. If this
65	65	Act does not receive the vote necessary for immediate effect, this
66	66	Act takes effect September 1, 2017.
