98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10- SECTION 1. Chapter 6604, Special District Local Laws Code,
11- is amended by adding Section 6604.108 to read as follows:

10+ Local Laws Code, is amended by adding Section 6604.108 to read as
11+ follows:
1212 Sec. 6604.108. COMPENSATORY MITIGATION PROGRAM. (a) In
1313 achieving the ultimate goal of minimizing the threat of flooding of
1414 Fort Bend County by implementing flood control measures, the
1515 district shall establish a compensatory mitigation program for
1616 stormwater flows for drainage areas that are less than 50 acres.
1717 (b) The district's compensatory mitigation program must
1818 allow compensatory mitigation measures to be taken on property that
1919 is associated with development of a site and may allow compensatory
2020 mitigation measures to be taken on property that is not associated
2121 with a site's development if the threat of flooding would be
2222 minimized at least as much as if the compensatory mitigation
2323 measures were taken on property associated with the site's
2424 development.
2525 (c) Compensatory mitigation measures authorized by the
2626 compensatory mitigation program may include:
2727 (1) the use of detention or retention facilities to
2828 store increases in stormwater flows that are attributable to
2929 impervious cover from development; and
3030 (2) any other appropriate measures that are
3131 demonstrated to minimize the threat of flooding.
3232 (d) A project to develop compensatory mitigation measures
3333 approved under the compensatory mitigation program may not be
3434 inconsistent with any applicable federal or state requirements
3535 relating to management or control of stormwater.
3636 (e) An application for approval of a compensatory
3737 mitigation project:
3838 (1) must include a demonstration that the threat of
3939 flooding will be minimized in accordance with the district's
4040 purposes;
4141 (2) must be signed, sealed, and dated by an engineer
4242 licensed by the Texas Board of Professional Engineers under Chapter
4343 1001, Occupations Code;
4444 (3) may use calculations that are in accordance with
4545 acceptable engineering practices to determine the amount of flood
4646 control storage necessary based on increased impervious cover
4747 resulting from development; and
4848 (4) may include use of a compensatory mitigation bank
4949 in which credits can be issued to one or more site developers that
5050 allow a site developer to rely on the compensatory mitigation
5151 measures to reduce the threat of flooding.
5252 (f) The district engineer or other designee of the district
5353 shall approve or deny an application for approval of a compensatory
5454 mitigation project not later than the 90th day after the date the
5555 application is submitted, unless the applicant agrees to an
5656 extension. The decision by the district engineer or other designee
5757 of the district may be appealed directly to the commissioners court
5858 by the applicant.
5959 SECTION 2. This Act takes effect September 1, 2017.
