9	9	AN ACT
10	10	relating to certain meetings required by a prescriptive authority
11	11	agreement.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Sections 157.0512(e) and (f), Occupations Code,
14	14	are amended to read as follows:
15	15	(e) A prescriptive authority agreement must, at a minimum:
16	16	(1) be in writing and signed and dated by the parties
17	17	to the agreement;
18	18	(2) state the name, address, and all professional
19	19	license numbers of the parties to the agreement;
20	20	(3) state the nature of the practice, practice
21	21	locations, or practice settings;
22	22	(4) identify the types or categories of drugs or
23	23	devices that may be prescribed or the types or categories of drugs
24	24	or devices that may not be prescribed;
25	25	(5) provide a general plan for addressing consultation
26	26	and referral;
27	27	(6) provide a plan for addressing patient emergencies;
28	28	(7) state the general process for communication and
29	29	the sharing of information between the physician and the advanced
30	30	practice registered nurse or physician assistant to whom the
31	31	physician has delegated prescriptive authority related to the care
32	32	and treatment of patients;
33	33	(8) if alternate physician supervision is to be
34	34	utilized, designate one or more alternate physicians who may:
35	35	(A) provide appropriate supervision on a
36	36	temporary basis in accordance with the requirements established by
37	37	the prescriptive authority agreement and the requirements of this
38	38	subchapter; and
39	39	(B) participate in the prescriptive authority
40	40	quality assurance and improvement plan meetings required under this
41	41	section; and
42	42	(9) describe a prescriptive authority quality
43	43	assurance and improvement plan and specify methods for documenting
44	44	the implementation of the plan that include [includes] the
45	45	following:
46	46	(A) chart review, with the number of charts to be
47	47	reviewed determined by the physician and advanced practice
48	48	registered nurse or physician assistant; and
49	49	(B) periodic [face-to-face] meetings between the
50	50	advanced practice registered nurse or physician assistant and the
51	51	physician [at a location determined by the physician and the
52	52	advanced practice registered nurse or physician assistant].
53	53	(f) The periodic [face-to-face] meetings described by
54	54	Subsection (e)(9)(B) must:
55	55	(1) include:
56	56	(A) the sharing of information relating to
57	57	patient treatment and care, needed changes in patient care plans,
58	58	and issues relating to referrals; and
59	59	(B) discussion of patient care improvement;
60	60	[and]
61	61	(2) be documented; and
62	62	(3) take place at least once a month in a manner
63	63	determined by the physician and the advanced practice registered
64	64	nurse or physician assistant [occur:
65	65	[(A) except as provided by Paragraph (B):
66	66	[(i) at least monthly until the third
67	67	anniversary of the date the agreement is executed; and
68	68	[(ii) at least quarterly after the third
69	69	anniversary of the date the agreement is executed, with monthly
70	70	meetings held between the quarterly meetings by means of a remote
71	71	electronic communications system, including videoconferencing
72	72	technology or the Internet; or
73	73	[(B) if during the seven years preceding the date
74	74	the agreement is executed the advanced practice registered nurse or
75	75	physician assistant for at least five years was in a practice that
76	76	included the exercise of prescriptive authority with required
77	77	physician supervision:
78	78	[(i) at least monthly until the first
79	79	anniversary of the date the agreement is executed; and
80	80	[(ii) at least quarterly after the first
81	81	anniversary of the date the agreement is executed, with monthly
82	82	meetings held between the quarterly meetings by means of a remote
83	83	electronic communications system, including videoconferencing
84	84	technology or the Internet].
85	85	SECTION 2. Section 157.0512, Occupations Code, as amended
86	86	by this Act, applies only to a prescriptive authority agreement
87	87	entered into on or after the effective date of this Act. An
88	88	agreement entered into before the effective date of this Act is
89	89	governed by the law in effect on the date the agreement was entered
90	90	into, and the former law is continued in effect for that purpose.
91	91	SECTION 3. This Act takes effect September 1, 2017.
