9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 560, Insurance Code, is amended by | |
11 | 11 | adding Section 560.003 to read as follows: | |
12 | 12 | Sec. 560.003. PROHIBITION ON USE OF CERTAIN LOSS AND | |
13 | 13 | EXPENSE EXPERIENCE. An insurer may not: | |
14 | 14 | (1) consider loss and expense experience from any | |
15 | 15 | business other than the business of insurance in setting a premium | |
16 | 16 | rate used by the insurer; or | |
17 | 17 | (2) include loss and expense experience described by | |
18 | 18 | Subdivision (1) in a rate filing made under this code. | |
19 | 19 | SECTION 2. Section 560.003, Insurance Code, as added by | |
20 | 20 | this Act, applies only to a premium rate used, or a rate filing | |
21 | 21 | made, on or after January 1, 2018. A premium rate used, or a rate | |
22 | 22 | filing made, before January 1, 2018, is governed by the law as it | |
23 | 23 | existed immediately before the effective date of this Act, and that | |
24 | 24 | law is continued in effect for that purpose. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2017. |
