| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 38, Insurance Code, is amended by adding |
|---|
| 12 | 12 | | Subchapter K to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER K. CLAIMS REPORTING BY CERTAIN INSURERS |
|---|
| 14 | 14 | | Sec. 38.501. CLAIMS REPORTING BY AUTOMOBILE OR PROPERTY |
|---|
| 15 | 15 | | INSURER. (a) In this subchapter, "insurer" means an insurance |
|---|
| 16 | 16 | | company, reciprocal or interinsurance exchange, mutual insurance |
|---|
| 17 | 17 | | company, capital stock company, county mutual insurance company, |
|---|
| 18 | 18 | | Lloyd's plan, or other legal entity engaged in the business of |
|---|
| 19 | 19 | | personal automobile insurance or residential property insurance in |
|---|
| 20 | 20 | | this state. |
|---|
| 21 | 21 | | (b) An insurer shall submit a quarterly report to the |
|---|
| 22 | 22 | | department containing the following information organized by zip |
|---|
| 23 | 23 | | code: |
|---|
| 24 | 24 | | (1) the number of claims filed with the insurer; and |
|---|
| 25 | 25 | | (2) for each claim: |
|---|
| 26 | 26 | | (A) the date the claim was filed with the |
|---|
| 27 | 27 | | insurer; |
|---|
| 28 | 28 | | (B) the date the claim was paid by the insurer; |
|---|
| 29 | 29 | | (C) the amount of loss claimed within the |
|---|
| 30 | 30 | | applicable policy limits; and |
|---|
| 31 | 31 | | (D) the amount paid by the insurer to the |
|---|
| 32 | 32 | | claimant. |
|---|
| 33 | 33 | | (c) The commissioner by rule shall adopt the form of the |
|---|
| 34 | 34 | | report required under Subsection (b). |
|---|
| 35 | 35 | | SECTION 2. Not later than December 31, 2017, the |
|---|
| 36 | 36 | | commissioner of insurance shall adopt rules to implement Subchapter |
|---|
| 37 | 37 | | K, Chapter 38, Insurance Code, as added by this Act. The rules must |
|---|
| 38 | 38 | | require that an insurance company subject to that subchapter make |
|---|
| 39 | 39 | | the initial submission of the report under that subchapter not |
|---|
| 40 | 40 | | later than the 60th day after the effective date of the rules. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2017. |
