77 relating to the reporting of certain claims information by
88 automobile and residential property insurers to the Texas
99 Department of Insurance.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 38, Insurance Code, is amended by adding
1212 Subchapter K to read as follows:
1313 SUBCHAPTER K. CLAIMS REPORTING BY CERTAIN INSURERS
1414 Sec. 38.501. CLAIMS REPORTING BY AUTOMOBILE OR PROPERTY
1515 INSURER. (a) In this subchapter, "insurer" means an insurance
1616 company, reciprocal or interinsurance exchange, mutual insurance
1717 company, capital stock company, county mutual insurance company,
1818 Lloyd's plan, or other legal entity engaged in the business of
1919 personal automobile insurance or residential property insurance in
2020 this state.
2121 (b) An insurer shall submit a quarterly report to the
2222 department containing the following information organized by zip
2323 code:
2424 (1) the number of claims filed with the insurer; and
2525 (2) for each claim:
2626 (A) the date the claim was filed with the
2727 insurer;
2828 (B) the date the claim was paid by the insurer;
2929 (C) the amount of loss claimed within the
3030 applicable policy limits; and
3131 (D) the amount paid by the insurer to the
3232 claimant.
3333 (c) The commissioner by rule shall adopt the form of the
3434 report required under Subsection (b).
3535 SECTION 2. Not later than December 31, 2017, the
3636 commissioner of insurance shall adopt rules to implement Subchapter
3737 K, Chapter 38, Insurance Code, as added by this Act. The rules must
3838 require that an insurance company subject to that subchapter make
3939 the initial submission of the report under that subchapter not
4040 later than the 60th day after the effective date of the rules.
4141 SECTION 3. This Act takes effect September 1, 2017.
