| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 33.002(b), Insurance Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (b) A person is not eligible for appointment as commissioner | |
| 13 | 13 | if the person: | |
| 14 | 14 | (1) is a stockholder, director, officer, attorney, | |
| 15 | 15 | agent, or employee of an insurance company, insurance agent, | |
| 16 | 16 | insurance broker, or insurance adjuster; [or] | |
| 17 | 17 | (2) is directly or indirectly interested in a business | |
| 18 | 18 | described by Subdivision (1); or | |
| 19 | 19 | (3) has been employed by or otherwise professionally | |
| 20 | 20 | associated with an insurance company in the preceding five years. | |
| 21 | 21 | SECTION 2. The change in law made by this Act to Section | |
| 22 | 22 | 33.002, Insurance Code, applies only to the eligibility of a person | |
| 23 | 23 | appointed on or after the effective date of this Act to serve as the | |
| 24 | 24 | commissioner of insurance. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2017. |
