| 10 | 10 | | Board of a repository of student transcripts for certain private |
|---|
| 11 | 11 | | postsecondary educational institutions; authorizing fees and |
|---|
| 12 | 12 | | providing administrative penalties. |
|---|
| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 61.315, Education Code, is amended to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | Sec. 61.315. AGENTS AND RECORDS; TRANSCRIPT REPOSITORY FOR |
|---|
| 17 | 17 | | CERTAIN CLOSED INSTITUTIONS AND RELATED FEES. (a) The authorized |
|---|
| 18 | 18 | | or certified institutions may be required to furnish a list of their |
|---|
| 19 | 19 | | agents to the board, and to maintain records of students enrolled, |
|---|
| 20 | 20 | | credits awarded, and degrees awarded in a manner specified by the |
|---|
| 21 | 21 | | board. |
|---|
| 22 | 22 | | (b) The board shall maintain a repository for student |
|---|
| 23 | 23 | | transcripts from closed institutions that were issued a certificate |
|---|
| 24 | 24 | | of authority under Section 61.306 or a certificate of authorization |
|---|
| 25 | 25 | | under Section 61.303. The board may charge a fee to students |
|---|
| 26 | 26 | | requesting transcript copies maintained in the repository, not to |
|---|
| 27 | 27 | | exceed the cost of retrieving, reproducing, and sending the |
|---|
| 28 | 28 | | transcript copies. |
|---|
| 29 | 29 | | (c) An institution that was issued a certificate of |
|---|
| 30 | 30 | | authority under Section 61.306 or a certificate of authorization |
|---|
| 31 | 31 | | under Section 61.303 shall provide its student transcript records |
|---|
| 32 | 32 | | to the board in the format specified by the board for inclusion in |
|---|
| 33 | 33 | | the repository at least biennially and on or immediately before the |
|---|
| 34 | 34 | | date of closing. |
|---|
| 35 | 35 | | (d) The board may adopt rules for the administration of this |
|---|
| 36 | 36 | | section. |
|---|
| 37 | 37 | | SECTION 2. Section 61.316, Education Code, is amended by |
|---|
| 38 | 38 | | adding Subsection (e-2) to read as follows: |
|---|
| 39 | 39 | | (e-2) Any institution that was issued a certificate of |
|---|
| 40 | 40 | | authority under Section 61.306 or a certificate of authorization |
|---|
| 41 | 41 | | under Section 61.303 that fails to provide student transcript |
|---|
| 42 | 42 | | records to the board as required under Section 61.315 shall be |
|---|
| 43 | 43 | | assessed an administrative penalty of not less than $100 or more |
|---|
| 44 | 44 | | than $500 for each student whose transcript was not provided. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2017. |
