99 relating to the creation by the Texas Higher Education Coordinating
1010 Board of a repository of student transcripts for certain private
1111 postsecondary educational institutions; authorizing fees and
1212 providing administrative penalties.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 61.315, Education Code, is amended to
1515 read as follows:
1616 Sec. 61.315. AGENTS AND RECORDS; TRANSCRIPT REPOSITORY FOR
1717 CERTAIN CLOSED INSTITUTIONS AND RELATED FEES. (a) The authorized
1818 or certified institutions may be required to furnish a list of their
1919 agents to the board, and to maintain records of students enrolled,
2020 credits awarded, and degrees awarded in a manner specified by the
2121 board.
2222 (b) The board shall maintain a repository for student
2323 transcripts from closed institutions that were issued a certificate
2424 of authority under Section 61.306 or a certificate of authorization
2525 under Section 61.303. The board may charge a fee to students
2626 requesting transcript copies maintained in the repository, not to
2727 exceed the cost of retrieving, reproducing, and sending the
2828 transcript copies.
2929 (c) An institution that was issued a certificate of
3030 authority under Section 61.306 or a certificate of authorization
3131 under Section 61.303 shall provide its student transcript records
3232 to the board in the format specified by the board for inclusion in
3333 the repository at least biennially and on or immediately before the
3434 date of closing.
3535 (d) The board may adopt rules for the administration of this
3636 section.
3737 SECTION 2. Section 61.316, Education Code, is amended by
3838 adding Subsection (e-2) to read as follows:
3939 (e-2) Any institution that was issued a certificate of
4040 authority under Section 61.306 or a certificate of authorization
4141 under Section 61.303 that fails to provide student transcript
4242 records to the board as required under Section 61.315 shall be
4343 assessed an administrative penalty of not less than $100 or more
4444 than $500 for each student whose transcript was not provided.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2017.
