| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 112, Transportation Code, | |
| 11 | 11 | is amended by adding Section 112.063 to read as follows: | |
| 12 | 12 | Sec. 112.063. HIGH-SPEED RAIL TECHNOLOGIES. (a) In this | |
| 13 | 13 | section: | |
| 14 | 14 | (1) "High-speed rail" means intercity passenger | |
| 15 | 15 | service that is reasonably expected to reach speeds of at least 110 | |
| 16 | 16 | miles per hour. | |
| 17 | 17 | (2) "Rail facility" has the meaning assigned by | |
| 18 | 18 | Section 91.001. | |
| 19 | 19 | (b) A private entity that constructs a rail facility for | |
| 20 | 20 | high-speed rail service shall ensure that the facility is | |
| 21 | 21 | compatible with more than one type of train technology. | |
| 22 | 22 | (c) The department shall adopt rules as necessary to | |
| 23 | 23 | implement this section. | |
| 24 | 24 | SECTION 2. This Act takes effect September 1, 2017. |
