| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 112.051, Transportation Code, is amended | |
| 11 | 11 | by adding Subsection (d) to read as follows: | |
| 12 | 12 | (d) This section does not apply to a private entity | |
| 13 | 13 | operating or developing passenger rail service: | |
| 14 | 14 | (1) between a municipality with a population of more | |
| 15 | 15 | than 1.19 million and less than 1.3 million and a municipality with | |
| 16 | 16 | a population of 1.9 million or more; and | |
| 17 | 17 | (2) capable of operating at speeds greater than 120 | |
| 18 | 18 | miles per hour. | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2017. |
