66 AN ACT
77 relating to the security of high-speed rail operated by a private
88 entity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 112, Transportation Code, is amended by
1111 adding Subchapter E to read as follows:
1212 SUBCHAPTER E. SECURITY FOR HIGH-SPEED RAIL OPERATED BY PRIVATE
1313 ENTITY
1414 Sec. 112.201. DEFINITION. In this subchapter, "high-speed
1515 rail" means intercity passenger rail service that is reasonably
1616 expected to reach speeds of at least 110 miles per hour.
1717 Sec. 112.202. APPLICABILITY. This subchapter applies only
1818 to high-speed rail operated by a private entity.
1919 Sec. 112.203. DEPARTMENT OF PUBLIC SAFETY POWERS AND
2020 DUTIES. (a) To the extent not preempted by federal law, the
2121 Department of Public Safety:
2222 (1) shall administer and enforce the provisions of
2323 this subchapter; and
2424 (2) may adopt rules as necessary to administer this
2525 subchapter.
2626 (b) In carrying out the powers and duties under this
2727 subchapter, the Department of Public Safety has the same authority
2828 granted to the Texas Department of Transportation under Subchapter
2929 B, Chapter 111.
3030 (c) The Department of Public Safety shall provide the
3131 emergency management training course described by Section 418.005,
3232 Government Code, to employees of a high-speed rail line designated
3333 under Section 112.204(c).
3434 Sec. 112.204. SECURITY. (a) A high-speed rail operator
3535 shall, in the manner required by law for Amtrak, as defined by 49
3636 U.S.C. Section 24301, including by implementing any measures
3737 required by regulations or guidelines adopted for Amtrak by the
3838 Transportation Security Administration or a successor agency:
3939 (1) establish secured areas;
4040 (2) operate security screening stations; and
4141 (3) provide on-board security for the entire rail
4242 line.
4343 (b) A high-speed rail operator shall collect and
4444 investigate security threat reports submitted by members of the
4545 public.
4646 (c) A high-speed rail operator shall:
4747 (1) designate employees who are managers or
4848 supervisors and whose position description, job duties, or
4949 assignment includes emergency management responsibilities; and
5050 (2) require those employees to complete the emergency
5151 management training described by Section 418.005, Government Code.
5252 (d) A high-speed rail operator may not use the services of a
5353 peace officer employed by this state or a political subdivision of
5454 this state unless the operator compensates the state or political
5555 subdivision, as applicable, for the officer's time.
5656 Sec. 112.205. COORDINATION WITH OTHER ENTITIES. (a) A
5757 high-speed rail operator shall coordinate security activities and
5858 investigations with local law enforcement agencies, including by
5959 communicating about credible threats, major events, and vulnerable
6060 places along the rail line or on a train.
6161 (b) A high-speed rail operator shall communicate as
6262 appropriate with the state Emergency Management Council and the
6363 Texas Division of Emergency Management about security issues.
6464 SECTION 2. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2017.
