| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 199, Transportation Code, is amended by | |
| 11 | 11 | adding Section 199.003 to read as follows: | |
| 12 | 12 | Sec. 199.003. USE OF STATE MONEY FOR HIGH-SPEED RAIL. (a) | |
| 13 | 13 | For the purposes of this section, "high-speed rail" means intercity | |
| 14 | 14 | passenger rail service that is reasonably expected to reach speeds | |
| 15 | 15 | of at least 110 miles per hour. | |
| 16 | 16 | (b) Except as required by other law, including the National | |
| 17 | 17 | Environmental Policy Act of 1969 (42 U.S.C. Section 4321 et seq.): | |
| 18 | 18 | (1) the legislature may not appropriate money to pay | |
| 19 | 19 | for a cost of planning, facility construction or maintenance, or | |
| 20 | 20 | security for, or operation of, high-speed rail operated by a | |
| 21 | 21 | private entity; and | |
| 22 | 22 | (2) a state agency may not accept or use state money to | |
| 23 | 23 | pay for a cost described by Subdivision (1). | |
| 24 | 24 | (c) A state agency shall prepare a quarterly report of each | |
| 25 | 25 | expense described by this section and submit a copy of each report | |
| 26 | 26 | to: | |
| 27 | 27 | (1) the commission; | |
| 28 | 28 | (2) the committee in each house of the legislature | |
| 29 | 29 | with primary jurisdiction over transportation; | |
| 30 | 30 | (3) the lieutenant governor; and | |
| 31 | 31 | (4) the governor. | |
| 32 | 32 | SECTION 2. This Act takes effect September 1, 2017. |
