66 AN ACT
77 relating to the qualifications to serve as an emergency services
88 commissioner in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 775.0355(b) and (c), Health and Safety
1111 Code, are amended to read as follows:
1212 (b) This section applies only to a district located [wholly
1313 in a county]:
1414 (1) wholly or partly in a county with a population of
1515 more than three million;
1616 (2) wholly in a county with a population of more than
1717 200,000 that borders Lake Palestine; or
1818 (3) wholly in a county with a population of less than
1919 200,000 that borders another state and the Gulf Intracoastal
2020 Waterway.
2121 (c) A person is disqualified from serving as an emergency
2222 services commissioner if that person:
2323 (1) is related within the third degree of affinity or
2424 consanguinity to:
2525 (A) a person providing professional services to
2626 the district;
2727 (B) a commissioner of the same district; or
2828 (C) a person who is an employee or volunteer of an
2929 emergency services organization that is providing emergency
3030 services to the district, other than an organization providing
3131 emergency services to the district under a mutual aid agreement
3232 under Chapter 418, Government Code;
3333 (2) is an employee of a commissioner of the same
3434 district, attorney, or other person providing professional
3535 services to the district;
3636 (3) is serving as an attorney, consultant, or
3737 architect or in some other professional capacity for the district
3838 or an emergency services organization providing emergency services
3939 to the district; or
4040 (4) fails to maintain the qualifications required by
4141 law to serve as a commissioner.
4242 SECTION 2. This Act takes effect September 1, 2017.
