| 7 | 7 | | relating to transitional child-care services in the Temporary |

| 8 | 8 | | Assistance for Needy Families (TANF) program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 31.012(c), Human Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) A person who is the caretaker of a child with a physical |
|---|
| 13 | 13 | | disability or mental, intellectual, or developmental disability |
|---|
| 14 | 14 | | who requires the caretaker's presence is not required to |
|---|
| 15 | 15 | | participate in a program under this section. A single person who is |
|---|
| 16 | 16 | | the caretaker of a child is exempt until the caretaker's youngest |
|---|
| 17 | 17 | | child at the time the caretaker first became eligible for |
|---|
| 18 | 18 | | assistance reaches the age of one. Notwithstanding Section |
|---|
| 19 | 19 | | [Sections 31.0035(b) and] 32.0255(b), the Health and Human Services |
|---|
| 20 | 20 | | Commission shall provide to a person who is exempt under this |
|---|
| 21 | 21 | | subsection and who voluntarily participates in a program under |
|---|
| 22 | 22 | | Subsection (a)(2) six months of transitional benefits in addition |
|---|
| 23 | 23 | | to the applicable limit prescribed by Section 31.0065. |
|---|
| 24 | 24 | | SECTION 2. Section 31.0035, Human Resources Code, is |
|---|
| 25 | 25 | | repealed. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2017. |
