55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement that certain recipients of financial
88 assistance from the Texas Water Development Board adopt certain
99 restrictions on water use by their customers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 15, Water Code, is amended
1212 by adding Section 15.009 to read as follows:
1313 Sec. 15.009. FINANCIAL ASSISTANCE; WATERING RESTRICTIONS.
1414 (a) This section applies only to financial assistance provided
1515 under this chapter:
1616 (1) for a municipal water supply project;
1717 (2) in an amount that exceeds $500,000; and
1818 (3) to an entity that:
1919 (A) is a:
2020 (i) retail public utility as defined by
2121 Section 13.002; and
2222 (ii) public entity; and
2323 (B) is not a:
2424 (i) political subdivision that is primarily
2525 a wholesale water provider; or
2626 (ii) nonprofit water supply corporation
2727 created and operating under Chapter 67.
2828 (b) The board may waive the requirements of this section for
2929 financial assistance sought to meet an emergency need.
3030 (c) Financial assistance provided under this chapter shall
3131 include conditions that require the recipient to have a water
3232 conservation program in place that includes enforceable
3333 time-of-day limitations on outdoor watering by its customers.
3434 (d) The board shall:
3535 (1) adopt rules to implement this section; and
3636 (2) provide guidance to recipients of financial
3737 assistance provided under this chapter in developing and
3838 implementing programs that meet the requirements of this section
3939 and rules adopted to implement this section.
4040 SECTION 2. Subchapter B, Chapter 16, Water Code, is amended
4141 by adding Section 16.025 to read as follows:
4242 Sec. 16.025. FINANCIAL ASSISTANCE; WATERING RESTRICTIONS.
4343 (a) This section applies only to financial assistance provided
4444 under this chapter:
4545 (1) for a municipal water supply project;
4646 (2) in an amount that exceeds $500,000; and
4747 (3) to an entity that:
4848 (A) is a:
4949 (i) retail public utility as defined by
5050 Section 13.002; and
5151 (ii) public entity; and
5252 (B) is not a:
5353 (i) political subdivision that is primarily
5454 a wholesale water provider; or
5555 (ii) nonprofit water supply corporation
5656 created and operating under Chapter 67.
5757 (b) The board may waive the requirements of this section for
5858 financial assistance sought to meet an emergency need.
5959 (c) Financial assistance provided under this chapter shall
6060 include conditions that require the recipient to have a water
6161 conservation program in place that includes enforceable
6262 time-of-day limitations on outdoor watering by its customers.
6363 (d) The board shall:
6464 (1) adopt rules to implement this section; and
6565 (2) provide guidance to recipients of financial
6666 assistance provided under this chapter in developing and
6767 implementing programs that meet the requirements of this section
6868 and rules adopted to implement this section.
6969 SECTION 3. Subchapter A, Chapter 17, Water Code, is amended
7070 by adding Section 17.004 to read as follows:
7171 Sec. 17.004. FINANCIAL ASSISTANCE; WATERING RESTRICTIONS.
7272 (a) This section applies only to financial assistance provided
7373 under this chapter:
7474 (1) for a municipal water supply project;
7575 (2) in an amount that exceeds $500,000; and
7676 (3) to an entity that:
7777 (A) is a:
7878 (i) retail public utility as defined by
7979 Section 13.002; and
8080 (ii) public entity; and
8181 (B) is not a:
8282 (i) political subdivision that is primarily
8383 a wholesale water provider; or
8484 (ii) nonprofit water supply corporation
8585 created and operating under Chapter 67.
8686 (b) The board may waive the requirements of this section for
8787 financial assistance sought to meet an emergency need.
8888 (c) Financial assistance provided under this chapter shall
8989 include conditions that require the recipient to have a water
9090 conservation program in place that includes enforceable
9191 time-of-day limitations on outdoor watering by its customers.
9292 (d) The board shall:
9393 (1) adopt rules to implement this section; and
9494 (2) provide guidance to recipients of financial
9595 assistance provided under this chapter in developing and
9696 implementing programs that meet the requirements of this section
9797 and rules adopted to implement this section.
9898 SECTION 4. (a) As soon as practicable after the effective
9999 date of this Act, the Texas Water Development Board shall adopt
100100 rules under Sections 15.009, 16.025, and 17.004, Water Code, as
101101 added by this Act.
102102 (b) Sections 15.009, 16.025, and 17.004, Water Code, as
103103 added by this Act, apply only to an application for financial
104104 assistance submitted to the Texas Water Development Board on or
105105 after the effective date of this Act. An application submitted
106106 before the effective date of this Act is governed by the law in
107107 effect immediately before the effective date of this Act, and the
108108 former law is continued in effect for that purpose.
109109 SECTION 5. This Act takes effect September 1, 2017.
