| 11 | 11 | SECTION 1. Subchapter F, Chapter 401, Government Code, is | |
| 12 | 12 | amended by adding Section 401.107 to read as follows: | |
| 13 | 13 | Sec. 401.107. TRANSFERS FOR PREKINDERGARTEN. (a) | |
| 14 | 14 | Notwithstanding any other provision of law, the governor may | |
| 15 | 15 | transfer to the Texas Education Agency any amounts appropriated to | |
| 16 | 16 | a trusteed program within the office of the governor. | |
| 17 | 17 | (b) Any amounts transferred by the governor under this | |
| 18 | 18 | section may be used by the Texas Education Agency only to finance | |
| 19 | 19 | amounts to which school districts are entitled under the Foundation | |
| 20 | 20 | School Program on the basis of the number of students in average | |
| 21 | 21 | daily attendance in prekindergarten programs under Subchapter E, | |
| 22 | 22 | Chapter 29, Education Code. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2017. |
