55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to education programs regarding AIDS and HIV infection.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 85.007(c), Health and Safety Code, is
1010 amended to read as follows:
1111 (c) In addition, the educational materials intended for
1212 persons younger than 18 years of age must:
1313 (1) emphasize that abstinence from sexual activity, if
1414 used consistently and correctly, is the only method that is 100
1515 percent effective in preventing pregnancy, sexually transmitted
1616 infections, sexually acquired infection with human
1717 immunodeficiency virus or acquired immune deficiency syndrome, and
1818 the emotional distress that may be associated with adolescent
1919 sexual activity [teach that sexual activity before marriage is
2020 likely to have harmful psychological and physical consequences];
2121 (2) teach adolescents ways to recognize and respond to
2222 unwanted physical and verbal sexual advances;
2323 (3) teach that the use of alcohol or drugs increases a
2424 person's vulnerability to unwanted sexual advances; and
2525 (4) emphasize the importance of attaining
2626 self-sufficiency before engaging in sexual activity.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2017.
