| 7 | 7 | | relating to education programs regarding AIDS and HIV infection. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 85.007(c), Health and Safety Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (c) In addition, the educational materials intended for |
|---|
| 12 | 12 | | persons younger than 18 years of age must: |
|---|
| 13 | 13 | | (1) emphasize that abstinence from sexual activity, if |
|---|
| 14 | 14 | | used consistently and correctly, is the only method that is 100 |
|---|
| 15 | 15 | | percent effective in preventing pregnancy, sexually transmitted |
|---|
| 16 | 16 | | infections, sexually acquired infection with human |
|---|
| 17 | 17 | | immunodeficiency virus or acquired immune deficiency syndrome, and |
|---|
| 18 | 18 | | the emotional distress that may be associated with adolescent |
|---|
| 19 | 19 | | sexual activity [teach that sexual activity before marriage is |
|---|
| 20 | 20 | | likely to have harmful psychological and physical consequences]; |
|---|
| 21 | 21 | | (2) teach adolescents ways to recognize and respond to |
|---|
| 22 | 22 | | unwanted physical and verbal sexual advances; |
|---|
| 23 | 23 | | (3) teach that the use of alcohol or drugs increases a |
|---|
| 24 | 24 | | person's vulnerability to unwanted sexual advances; and |
|---|
| 25 | 25 | | (4) emphasize the importance of attaining |
|---|
| 26 | 26 | | self-sufficiency before engaging in sexual activity. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2017. |
