55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to discovery procedures for a claim against a governmental
88 entity under the Texas Tort Claims Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 101, Civil Practice and
1111 Remedies Code, is amended by adding Section 101.110 to read as
1212 follows:
1313 Sec. 101.110. DISCOVERY RELATING TO PLEA TO JURISDICTION.
1414 The supreme court shall adopt rules under which a claimant under
1515 this chapter may, if the defendant asserts a plea to the
1616 jurisdiction, obtain reasonable discovery to investigate whether
1717 circumstances exist that would confer jurisdiction on the court.
1818 SECTION 2. This Act takes effect September 1, 2017.
