55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the amendment of an application for an allocation of low
88 income housing tax credits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.6708(a), Government Code, is
1111 amended to read as follows:
1212 (a) Except as provided by Subsection (b), an applicant may
1313 not change or supplement an application in any manner after the
1414 filing deadline, including a change or supplement related to the
1515 financial feasibility of the development as established for
1616 purposes of the department's evaluation under Section
1717 2306.6710(b)(1)(A).
1818 SECTION 2. The change in law made by this Act applies only
1919 to an application for low income housing tax credits that is
2020 submitted to the Texas Department of Housing and Community Affairs
2121 during an application cycle that is based on the 2018 qualified
2222 allocation plan or a subsequent plan adopted by the governing board
2323 of the department. An application that is submitted during an
2424 application cycle that is based on an earlier qualified allocation
2525 plan is governed by the law in effect on the date the application
2626 cycle began, and the former law is continued in effect for that
2727 purpose.
2828 SECTION 3. This Act takes effect September 1, 2017.
