99 relating to the civil liability of a hospital with a children's
1010 isolation unit and of certain hospital employees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 241, Health and Safety Code, is amended
1313 by adding Subchapter K to read as follows:
1414 SUBCHAPTER K. LIMITATION ON CIVIL LIABILITY OF HOSPITALS WITH
1515 CHILDREN'S ISOLATION UNIT
1616 Sec. 241.301. DEFINITION. In this subchapter, "children's
1717 isolation unit" means an isolation unit in a hospital licensed
1818 under this chapter that is designed to provide health care services
1919 to children with highly contagious infectious diseases.
2020 Sec. 241.302. LIMITATION ON CIVIL LIABILITY OF HOSPITAL
2121 WITH CHILDREN'S ISOLATION UNIT. A hospital with a children's
2222 isolation unit that has instituted isolation protocols and a
2323 physician or employee of that hospital are not liable for any claim,
2424 damage, or loss arising from the provision of health care services
2525 in the children's isolation unit to children with highly contagious
2626 diseases, unless the act or omission proximately causing the claim,
2727 damage, or loss constitutes gross negligence or wilful misconduct.
2828 SECTION 2. This Act takes effect September 1, 2017.
