| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 241, Health and Safety Code, is amended |

| 13 | 13 | | by adding Subchapter K to read as follows: |

| 14 | 14 | | SUBCHAPTER K. LIMITATION ON CIVIL LIABILITY OF HOSPITALS WITH |

| 15 | 15 | | CHILDREN'S ISOLATION UNIT |
|---|
| 16 | 16 | | Sec. 241.301. DEFINITION. In this subchapter, "children's |
|---|
| 17 | 17 | | isolation unit" means an isolation unit in a hospital licensed |
|---|
| 18 | 18 | | under this chapter that is designed to provide health care services |
|---|
| 19 | 19 | | to children with highly contagious infectious diseases. |
|---|
| 20 | 20 | | Sec. 241.302. LIMITATION ON CIVIL LIABILITY OF HOSPITAL |
|---|
| 21 | 21 | | WITH CHILDREN'S ISOLATION UNIT. A hospital with a children's |
|---|
| 22 | 22 | | isolation unit that has instituted isolation protocols and a |
|---|
| 23 | 23 | | physician or employee of that hospital are not liable for any claim, |
|---|
| 24 | 24 | | damage, or loss arising from the provision of health care services |
|---|
| 25 | 25 | | in the children's isolation unit to children with highly contagious |
|---|
| 26 | 26 | | diseases, unless the act or omission proximately causing the claim, |
|---|
| 27 | 27 | | damage, or loss constitutes gross negligence or wilful misconduct. |

| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2017. |
