99 relating to an increase in and the use of the fee for permits issued
1010 for the movement of oversize or overweight vehicles carrying cargo
1111 in Hidalgo County.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 623.364, Transportation Code, is amended
1414 to read as follows:
1515 Sec. 623.364. PERMIT FEES. (a) The authority may collect a
1616 fee for permits issued under this subchapter. Beginning September
1717 1, 2017 [2013], the maximum amount of the fee may not exceed $200
1818 [$80] per trip. On September 1 of each subsequent year, the
1919 authority may adjust the maximum fee amount as necessary to reflect
2020 the percentage change during the preceding year in the Consumer
2121 Price Index for All Urban Consumers (CPI-U), U.S. City Average,
2222 published monthly by the United States Bureau of Labor Statistics
2323 or its successor in function.
2424 (b) Except as provided by Subsection (c), fees [Fees]
2525 collected under Subsection (a) shall be used only for the
2626 construction and maintenance of the roads described by or
2727 designated under Section 623.363 and for the authority's
2828 administrative costs, which may not exceed 10 [15] percent of the
2929 fees collected. The authority shall make payments to the Texas
3030 Department of Transportation to provide funds for the maintenance
3131 of roads and highways subject to this subchapter.
3232 (c) Fees collected under Subsection (a) must be used in an
3333 amount not to exceed five percent of the fees collected to leverage
3434 funding from other sources to:
3535 (1) construct a bridge on Farm-to-Market Road 1015 in
3636 Hidalgo County between Military Highway and Mile 5 Road North;
3737 (2) improve the roads described by Section 623.363
3838 that are in Weslaco or Progreso;
3939 (3) improve Mile 5 Road North in Hidalgo County; and
4040 (4) support the construction of roads proposed by the
4141 City of Donna connecting a proposed commercial import lot near the
4242 Donna-Rio Bravo International Bridge to Farm-to-Market Road 493 and
4343 Military Highway.
4444 SECTION 2. This Act takes effect September 1, 2017.
