| 7 | 7 | | relating to the prosecution of the offense of sexual assault. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 22.011(c)(5), Penal Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (5) "Employee of a facility" means a person who is an |
|---|
| 12 | 12 | | employee of a child-care facility as defined by Section 42.002, |
|---|
| 13 | 13 | | Human Resources Code, or an employee of a facility defined by |
|---|
| 14 | 14 | | Section 250.001, Health and Safety Code, or any other person who |
|---|
| 15 | 15 | | provides services for a facility for compensation, including a |
|---|
| 16 | 16 | | contract laborer. |
|---|
| 17 | 17 | | SECTION 2. The change in law made by this Act applies only to |
|---|
| 18 | 18 | | an offense committed on or after the effective date of this Act. An |
|---|
| 19 | 19 | | offense committed before the effective date of this Act is governed |
|---|
| 20 | 20 | | by the law in effect on the date the offense was committed, and the |
|---|
| 21 | 21 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 22 | 22 | | this section, an offense was committed before the effective date of |
|---|
| 23 | 23 | | this Act if any element of the offense occurred before that date. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect September 1, 2017. |
