 A BILL TO BE ENTITLED
 AN ACT
 relating to a teacher to student ratio requirement for public
 school special education programs.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 25.111, Education Code, is amended to
 read as follows:
 Sec. 25.111.  STUDENT/TEACHER RATIOS. (a) Except as
 provided by Subsection (b) and Section 25.112, each school district
 must employ a sufficient number of teachers certified under
 Subchapter B, Chapter 21, to maintain an average ratio of not less
 than one teacher for each 20 students in average daily attendance.
 (b)  For each student enrolled in a special education program
 under Subchapter A, Chapter 29, a school district or
 open-enrollment charter school must assign a teacher certified
 under Subchapter B, Chapter 21, sufficient to maintain a ratio of
 not less than one teacher for each three students who receive
 special education services in a self-contained classroom or other
 special education setting.
 SECTION 2.  This Act applies beginning with the 2017-2018
 school year.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2017.
