9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 25.111, Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 25.111. STUDENT/TEACHER RATIOS. (a) Except as |
---|
13 | 13 | | provided by Subsection (b) and Section 25.112, each school district |
---|
14 | 14 | | must employ a sufficient number of teachers certified under |
---|
15 | 15 | | Subchapter B, Chapter 21, to maintain an average ratio of not less |
---|
16 | 16 | | than one teacher for each 20 students in average daily attendance. |
---|
17 | 17 | | (b) For each student enrolled in a special education program |
---|
18 | 18 | | under Subchapter A, Chapter 29, a school district or |
---|
19 | 19 | | open-enrollment charter school must assign a teacher certified |
---|
20 | 20 | | under Subchapter B, Chapter 21, sufficient to maintain a ratio of |
---|
21 | 21 | | not less than one teacher for each three students who receive |
---|
22 | 22 | | special education services in a self-contained classroom or other |
---|
23 | 23 | | special education setting. |
---|
24 | 24 | | SECTION 2. This Act applies beginning with the 2017-2018 |
---|
25 | 25 | | school year. |
---|
26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2017. |
