66 AN ACT
77 relating to a teacher to student ratio requirement for public
88 school special education programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.111, Education Code, is amended to
1111 read as follows:
1212 Sec. 25.111. STUDENT/TEACHER RATIOS. (a) Except as
1313 provided by Subsection (b) and Section 25.112, each school district
1414 must employ a sufficient number of teachers certified under
1515 Subchapter B, Chapter 21, to maintain an average ratio of not less
1616 than one teacher for each 20 students in average daily attendance.
1717 (b) For each student enrolled in a special education program
1818 under Subchapter A, Chapter 29, a school district or
1919 open-enrollment charter school must assign a teacher certified
2020 under Subchapter B, Chapter 21, sufficient to maintain a ratio of
2121 not less than one teacher for each three students who receive
2222 special education services in a self-contained classroom or other
2323 special education setting.
2424 SECTION 2. This Act applies beginning with the 2017-2018
2525 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2017.
