55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the ineligibility of certain persons affiliated with an
88 open-enrollment charter school for election to or service on the
99 State Board of Education or a school district board of trustees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 7.103, Education Code, is amended by
1212 amending Subsection (a) and adding Subsections (a-1) and (d) to
1313 read as follows:
1414 (a) A person is not eligible for election to or service on
1515 the board if the person:
1616 (1) holds an office with this state or any political
1717 subdivision of this state;
1818 (2) is:
1919 (A) an employee, officer, or member of the
2020 governing body of an open-enrollment charter school; or
2121 (B) a member of the governing body of a charter
2222 holder;
2323 (3) is required to register as a lobbyist under
2424 Chapter 305, Government Code, by virtue of the person's activities
2525 for compensation on behalf of an open-enrollment charter school,
2626 governing body of an open-enrollment charter school, charter
2727 holder, governing body of a charter holder, or management company;
2828 (4) has an interest in a management company; or
2929 (5) in any way represents the interests of an
3030 open-enrollment charter school that are directly or indirectly in
3131 conflict with the interests of an independent school district.
3232 (a-1) For purposes of Subsection (a)(4), a person has an
3333 interest in a management company if:
3434 (1) the person owns five percent or more of the voting
3535 stock or shares of the management company;
3636 (2) the person owns five percent or more of the fair
3737 market value of the management company; or
3838 (3) money received by the person from the management
3939 company exceeds five percent of the person's gross income for the
4040 preceding calendar year.
4141 (d) In this section, "charter holder," "governing body of a
4242 charter holder," "governing body of an open-enrollment charter
4343 school," "management company," and "officer of an open-enrollment
4444 charter school" have the meanings assigned by Section 12.1012.
4545 SECTION 2. Section 11.061, Education Code, is amended by
4646 adding Subsections (b-1), (b-2), and (e) to read as follows:
4747 (b-1) A person may not be elected trustee of an independent
4848 school district or appointed to fill a vacancy on the board of
4949 trustees of an independent school district if the person:
5050 (1) is:
5151 (A) an employee, officer, or member of the
5252 governing body of an open-enrollment charter school; or
5353 (B) a member of the governing body of a charter
5454 holder;
5555 (2) is required to register as a lobbyist under
5656 Chapter 305, Government Code, by virtue of the person's activities
5757 for compensation on behalf of an open-enrollment charter school,
5858 governing body of an open-enrollment charter school, charter
5959 holder, governing body of a charter holder, or management company;
6060 (3) has an interest in a management company; or
6161 (4) in any way represents the interests of an
6262 open-enrollment charter school that are directly or indirectly in
6363 conflict with the interests of an independent school district.
6464 (b-2) For purposes of Subsection (b-1)(3), a person has an
6565 interest in a management company if:
6666 (1) the person owns five percent or more of the voting
6767 stock or shares of the management company;
6868 (2) the person owns five percent or more of the fair
6969 market value of the management company; or
7070 (3) money received by the person from the management
7171 company exceeds five percent of the person's gross income for the
7272 preceding calendar year.
7373 (e) In this section, "charter holder," "governing body of a
7474 charter holder," "governing body of an open-enrollment charter
7575 school," "management company," and "officer of an open-enrollment
7676 charter school" have the meanings assigned by Section 12.1012.
7777 SECTION 3. The changes in law made by this Act regarding
7878 eligibility for membership on the State Board of Education or the
7979 board of trustees of an independent school district do not affect
8080 the entitlement of a member serving on the State Board of Education
8181 or the board of trustees of an independent school district
8282 immediately before the effective date of this Act to continue to
8383 carry out the board's functions for the remainder of the member's
8484 term. The changes in law apply only to a member elected or
8585 appointed on or after the effective date of this Act.
8686 SECTION 4. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2017.
