114 AN ACT
125 relating to the use of auction proceeds from the sale of certain
136 abandoned motor vehicles to reimburse law enforcement agencies for
147 compensation paid to certain property owners.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Section 683.015(a), Transportation Code, is
1710 amended to read as follows:
1811 (a) A law enforcement agency is entitled to reimbursement
1912 from the proceeds of the sale of an abandoned motor vehicle,
2013 aircraft, watercraft, or outboard motor for:
2114 (1) the cost of the auction;
2215 (2) towing, preservation, and storage fees resulting
2316 from the taking into custody; [and]
2417 (3) the cost of notice or publication as required by
2518 Section 683.012; and
2619 (4) any compensation made by the agency under
2720 Subsection (f) to property owners whose property was damaged as a
2821 result of a pursuit involving the motor vehicle.
2922 SECTION 2. Section 683.015(a), Transportation Code, as
3023 amended by this Act, applies only to proceeds of a sale of an
3124 abandoned motor vehicle that takes place on or after the effective
3225 date of this Act. Proceeds of a sale of an abandoned motor vehicle
3326 that takes place before the effective date of this Act are governed
3427 by the law in effect on the date of the sale, and the former law is
3528 continued in effect for that purpose.
3629 SECTION 3. This Act takes effect September 1, 2017.
