85R5718 ATP-F By: Miller H.B. No. 2311 A BILL TO BE ENTITLED AN ACT relating to a voter's use of an application for a ballot to be voted by mail to update the voter's residence. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 84.002, Election Code, is amended by adding Subsection (c) to read as follows: (c) An application for a ballot to be voted by mail may indicate a change of residence address. If the voter includes a change of residence address in the voter's application, the early voting clerk shall notify the appropriate voter registrars of the change and the registrars shall update the voter's voter registration information accordingly. SECTION 2. Section 84.011, Election Code, is amended by adding Subsection (c) to read as follows: (c) The officially prescribed application form for an early voting ballot to be voted by mail must include a space for the voter to provide a change of residence address. SECTION 3. Section 86.001(e), Election Code, is amended to read as follows: (e) If the applicant does not have an effective voter registration for the election, the clerk shall reject the application unless: (1) the clerk can determine from the voter registrar that the applicant has submitted a voter registration application and the registration will be effective on election day; or (2) the voter has provided a change of residence address on the voter's application for a ballot to be voted by mail and the voter's registration will be effective on election day. SECTION 4. This Act takes effect September 1, 2017.
