| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 411, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 411.1297 to read as follows: |
|---|
| 12 | 12 | | Sec. 411.1297. ACCESS TO CRIMINAL HISTORY RECORD |
|---|
| 13 | 13 | | INFORMATION: EMPLOYMENT BY EMERGENCY COMMUNICATION DISTRICT. (a) |
|---|
| 14 | 14 | | An emergency communication district created under Chapter 772, |
|---|
| 15 | 15 | | Health and Safety Code, is entitled to obtain from the department |
|---|
| 16 | 16 | | criminal history record information maintained by the department |
|---|
| 17 | 17 | | that relates to a person who is: |
|---|
| 18 | 18 | | (1) an applicant for employment by or an employee of |
|---|
| 19 | 19 | | the district; |
|---|
| 20 | 20 | | (2) an applicant for a volunteer position or a |
|---|
| 21 | 21 | | volunteer with the district; or |
|---|
| 22 | 22 | | (3) an applicant for employment by or an employee of a |
|---|
| 23 | 23 | | person that contracts with the district. |
|---|
| 24 | 24 | | (b) Criminal history record information obtained by an |
|---|
| 25 | 25 | | emergency communication district under Subsection (a) may not be |
|---|
| 26 | 26 | | released or disclosed to any person except: |
|---|
| 27 | 27 | | (1) in a criminal proceeding; |
|---|
| 28 | 28 | | (2) on court order; or |
|---|
| 29 | 29 | | (3) with the consent of the person who is the subject |
|---|
| 30 | 30 | | of the criminal history record information. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2017. |
