66 AN ACT
77 relating to access to criminal history record information by an
88 emergency communication district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 411, Government Code, is
1111 amended by adding Section 411.1297 to read as follows:
1212 Sec. 411.1297. ACCESS TO CRIMINAL HISTORY RECORD
1313 INFORMATION: EMPLOYMENT BY EMERGENCY COMMUNICATION DISTRICT. (a)
1414 An emergency communication district created under Chapter 772,
1515 Health and Safety Code, is entitled to obtain from the department
1616 criminal history record information maintained by the department
1717 that relates to a person who is:
1818 (1) an applicant for employment by or an employee of
1919 the district;
2020 (2) an applicant for a volunteer position or a
2121 volunteer with the district; or
2222 (3) an applicant for employment by or an employee of a
2323 person that contracts with the district.
2424 (b) Criminal history record information obtained by an
2525 emergency communication district under Subsection (a) may not be
2626 released or disclosed to any person except:
2727 (1) in a criminal proceeding;
2828 (2) on court order; or
2929 (3) with the consent of the person who is the subject
3030 of the criminal history record information.
3131 SECTION 2. This Act takes effect September 1, 2017.
