9 | 9 | | HE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended |
---|
11 | 11 | | by adding Section 151.3131 to read as follows: |
---|
12 | 12 | | Sec. 151.3131. FEMININE HYGIENE PRODUCTS. (a) In this |
---|
13 | 13 | | section, "feminine hygiene product" means tampons, panty liners, |
---|
14 | 14 | | sanitary napkins, and other similar tangible personal property sold |
---|
15 | 15 | | for the principal purpose of feminine hygiene in connection with |
---|
16 | 16 | | the menstrual cycle. |
---|
17 | 17 | | (b) The sale, use, or consumption of a feminine hygiene |
---|
18 | 18 | | product is exempted from the taxes imposed by this chapter if the |
---|
19 | 19 | | feminine hygiene product is purchased during the period described |
---|
20 | 20 | | by Section 151.326(a)(2). |
---|
21 | 21 | | SECTION 2. The change in law made by this Act does not |
---|
22 | 22 | | affect taxes imposed before the effective date of this Act, and the |
---|
23 | 23 | | law in effect before the effective date of this Act is continued in |
---|
24 | 24 | | effect for purposes of the liability for and collection of those |
---|
25 | 25 | | taxes. |

26 | 26 | | SECTION 3. This Act takes effect July 1, 2017, if it |
---|
27 | 27 | | receives a vote of two-thirds of all the members elected to each |
---|
28 | 28 | | house, as provided by Section 39, Article III, Texas Constitution. |
---|
29 | 29 | | If this Act does not receive the vote necessary for effect on that |
---|
30 | 30 | | date, this Act takes effect September 1, 2017. |
