| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 13.254, Water Code, is amended by adding | |
| 12 | 12 | Subsection (a-12) to read as follows: | |
| 13 | 13 | (a-12) Subsection (a-5) does not apply to a county: | |
| 14 | 14 | (1) with a population of more than 70,000 and less than | |
| 15 | 15 | 100,000 and contains a portion of the Colorado River; and | |
| 16 | 16 | (2) that is adjacent to a county with a population of | |
| 17 | 17 | one million or more. | |
| 18 | 18 | SECTION 2. The changes in law made by Section 13.254, Water | |
| 19 | 19 | Code, as amended by this Act, apply only to a petition filed on or | |
| 20 | 20 | after the effective date of this Act. A petition filed before the | |
| 21 | 21 | effective date of this Act is subject to the law in effect on the | |
| 22 | 22 | date the petition is filed, and that law is continued in effect for | |
| 23 | 23 | that purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2017. |
