88 AN ACT
99 relating to a candidate's application for a place on the ballot.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 141.031(a), Election Code, is amended to
1212 read as follows:
1313 (a) A candidate's application for a place on the ballot that
1414 is required by this code must:
1515 (1) be in writing;
1616 (2) be signed and sworn to by the candidate and
1717 indicate the date that the candidate swears to the application;
1818 (3) be timely filed with the appropriate authority;
1919 and
2020 (4) include:
2121 (A) the candidate's name;
2222 (B) the candidate's occupation;
2323 (C) the office sought, including any place number
2424 or other distinguishing number;
2525 (D) an indication of whether the office sought is
2626 to be filled for a full or unexpired term if the office sought and
2727 another office to be voted on have the same title but do not have
2828 place numbers or other distinguishing numbers;
2929 (E) a statement that the candidate is a United
3030 States citizen;
3131 (F) a statement that the candidate has not been
3232 determined by a final judgment of a court exercising probate
3333 jurisdiction to be:
3434 (i) totally mentally incapacitated; or
3535 (ii) partially mentally incapacitated
3636 without the right to vote;
3737 (G) a statement that the candidate has not been
3838 finally convicted of a felony from which the candidate has not been
3939 pardoned or otherwise released from the resulting disabilities;
4040 (H) the candidate's date of birth;
4141 (I) the candidate's residence address or, if the
4242 residence has no address, the address at which the candidate
4343 receives mail and a concise description of the location of the
4444 candidate's residence;
4545 (J) the candidate's length of continuous
4646 residence in the state and in the territory from which the office
4747 sought is elected as of the date the candidate swears to the
4848 application;
4949 (K) the statement: "I, __________, of
5050 __________ County, Texas, being a candidate for the office of
5151 __________, swear that I will support and defend the constitution
5252 and laws of the United States and of the State of Texas";
5353 (L) a statement that the candidate is aware of
5454 the nepotism law, Chapter 573, Government Code; and
5555 (M) a public mailing address at which the
5656 candidate receives correspondence relating to the candidate's
5757 campaign, if available, and an [any available] electronic mail
5858 address at which the candidate receives correspondence relating to
5959 the candidate's campaign, if available.
6060 SECTION 2. Section 141.039, Election Code, is amended to
6161 read as follows:
6262 Sec. 141.039. OFFICIAL APPLICATION FORM. In addition to
6363 the other statements and spaces for entering information that
6464 appear on an officially prescribed form for an application for a
6565 place on the ballot, each official form for an application that a
6666 candidate is required to file under this code must include:
6767 (1) a space for indicating the form in which the
6868 candidate's name is to appear on the ballot;
6969 (2) a space for the candidate's public mailing
7070 address;
7171 (3) spaces for the candidate's home and office
7272 telephone numbers and e-mail address at which the candidate
7373 receives correspondence relating to the candidate's campaign; and
7474 (4) a statement informing candidates that the
7575 furnishing of the telephone numbers [or e-mail address] is
7676 optional.
7777 SECTION 3. The change in law made by this Act to Section
7878 141.031(a), Election Code, applies to an application for a place on
7979 the ballot made on or after the effective date of this Act. An
8080 application for a place on the ballot made before the effective date
8181 of this Act is governed by the law in effect on the date the
8282 application is made, and the former law is continued in effect for
8383 that purpose.
8484 SECTION 4. This Act takes effect September 1, 2017.
