| 7 | 7 | | relating to the participation by certain state and local elected |

| 8 | 8 | | officials during the process for evaluating an application for a |
|---|
| 9 | 9 | | low income housing tax credit. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2306.6710, Government Code, is amended |
|---|
| 12 | 12 | | by adding Subsection (g) to read as follows: |
|---|
| 13 | 13 | | (g) If an application is the subject of a written statement |
|---|
| 14 | 14 | | provided under Subsection (b)(1)(J), the author of the statement |
|---|
| 15 | 15 | | may withdraw and amend the statement before the end of the |
|---|
| 16 | 16 | | application evaluation process provided by this section. The |
|---|
| 17 | 17 | | department shall consider the new statement instead of the |
|---|
| 18 | 18 | | withdrawn statement in scoring and ranking the application under |
|---|
| 19 | 19 | | Subsection (b). |

| 20 | 20 | | SECTION 2. Section 2306.6718, Government Code, is amended |
|---|
| 21 | 21 | | by adding Subsection (b-1) to read as follows: |
|---|
| 22 | 22 | | (b-1) If an elected official comments on an application |
|---|
| 23 | 23 | | during the application evaluation process provided by Section |
|---|
| 24 | 24 | | 2306.6710, the elected official may withdraw the comment and issue |
|---|
| 25 | 25 | | a new comment before the end of that process. The department shall |
|---|
| 26 | 26 | | consider the new comment instead of the withdrawn comment in |
|---|
| 27 | 27 | | evaluating applications under Section 2306.6710. |
|---|
| 28 | 28 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 29 | 29 | | to an application for low income housing tax credits that is |
|---|
| 30 | 30 | | submitted to the Texas Department of Housing and Community Affairs |
|---|
| 31 | 31 | | during an application cycle that is based on the 2018 qualified |
|---|
| 32 | 32 | | allocation plan or a subsequent plan adopted by the governing board |
|---|
| 33 | 33 | | of the department under Section 2306.67022, Government Code. An |
|---|
| 34 | 34 | | application that is submitted during an application cycle that is |
|---|
| 35 | 35 | | based on an earlier qualified allocation plan is governed by the law |
|---|
| 36 | 36 | | in effect on the date the application cycle began, and the former |
|---|
| 37 | 37 | | law is continued in effect for that purpose. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2017. |
