55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the participation by certain state and local elected
88 officials during the process for evaluating an application for a
99 low income housing tax credit.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2306.6710, Government Code, is amended
1212 by adding Subsection (g) to read as follows:
1313 (g) If an application is the subject of a written statement
1414 provided under Subsection (b)(1)(J), the author of the statement
1515 may withdraw and amend the statement before the end of the
1616 application evaluation process provided by this section. The
1717 department shall consider the new statement instead of the
1818 withdrawn statement in scoring and ranking the application under
1919 Subsection (b).
2020 SECTION 2. Section 2306.6718, Government Code, is amended
2121 by adding Subsection (b-1) to read as follows:
2222 (b-1) If an elected official comments on an application
2323 during the application evaluation process provided by Section
2424 2306.6710, the elected official may withdraw the comment and issue
2525 a new comment before the end of that process. The department shall
2626 consider the new comment instead of the withdrawn comment in
2727 evaluating applications under Section 2306.6710.
2828 SECTION 3. The change in law made by this Act applies only
2929 to an application for low income housing tax credits that is
3030 submitted to the Texas Department of Housing and Community Affairs
3131 during an application cycle that is based on the 2018 qualified
3232 allocation plan or a subsequent plan adopted by the governing board
3333 of the department under Section 2306.67022, Government Code. An
3434 application that is submitted during an application cycle that is
3535 based on an earlier qualified allocation plan is governed by the law
3636 in effect on the date the application cycle began, and the former
3737 law is continued in effect for that purpose.
3838 SECTION 4. This Act takes effect September 1, 2017.
