99 relating to the creation of a water park permit in the Alcoholic
1010 Beverage Code; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 3, Alcoholic Beverage Code, is
1313 amended by adding Chapter 56 to read as follows:
1414 CHAPTER 56. WATER PARK PERMIT
1515 Sec. 56.01. AUTHORIZED ACTIVITIES. Notwithstanding any
1616 other provision of this code, the holder of two or more water park
1717 permits may deliver alcoholic beverages from any premises for which
1818 one of those permits has been issued to any other premises for which
1919 one of those permits has been issued.
2020 Sec. 56.02. QUALIFICATIONS FOR PERMIT; ELIGIBLE PREMISES.
2121 (a) A water park permit may be issued only to a person who:
2222 (1) holds a wine and beer retailer's permit under
2323 Chapter 25; and
2424 (2) operates a public venue that:
2525 (A) involves waterslides, food service, music,
2626 and amusement activities; and
2727 (B) is located primarily along the banks of the
2828 Comal River.
2929 (b) A person described by Subsection (a) may be issued water
3030 park permits for not more than five premises:
3131 (1) for which wine and beer retailer's permits have
3232 been issued under Chapter 25; and
3333 (2) that are located:
3434 (A) in the public venue described in Subsection
3535 (a)(2); or
3636 (B) not more than one mile from the boundary of
3737 that venue.
3838 Sec. 56.03. FEE. The annual state fee for a water park
3939 permit is $30.
4040 Sec. 56.04. APPLICABILITY OF OTHER LAW. Except as
4141 otherwise provided in this chapter, the provisions of this code
4242 applicable to a wine and beer retailer's permit apply to a water
4343 park permit.
4444 SECTION 2. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2017.
