9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 171, Health and Safety | |
11 | 11 | Code, is amended by adding Section 171.006 to read as follows: | |
12 | 12 | Sec. 171.006. FETAL DEATH CERTIFICATE REQUIRED. (a) A | |
13 | 13 | physician or physician's agent shall file a fetal death certificate | |
14 | 14 | with the local registrar of the appropriate registration district | |
15 | 15 | in accordance with Chapter 193 and department rules for each death | |
16 | 16 | of an unborn child that occurs as a result of an abortion performed | |
17 | 17 | by the physician regardless of the gestational age of the unborn | |
18 | 18 | child at the time the abortion is performed. | |
19 | 19 | (b) The physician or physician's agent shall provide a copy | |
20 | 20 | of the fetal death certificate to the woman on whom the abortion was | |
21 | 21 | performed. | |
22 | 22 | SECTION 2. Section 171.006, Health and Safety Code, as | |
23 | 23 | added by this Act, applies only to an abortion performed on or after | |
24 | 24 | the effective date of this Act. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2017. |
