55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the system by which an application for a low income
88 housing tax credit is scored.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.6710(b), Government Code, is
1111 amended to read as follows:
1212 (b) If an application satisfies the threshold criteria, the
1313 department shall score and rank the application using a point
1414 system that:
1515 (1) prioritizes in descending order criteria
1616 regarding:
1717 (A) financial feasibility of the development
1818 based on the supporting financial data required in the application
1919 that will include a project underwriting pro forma from the
2020 permanent or construction lender;
2121 (B) quantifiable community participation with
2222 respect to the development, evaluated on the basis of a resolution
2323 concerning the development that is voted on and adopted by the
2424 following, as applicable:
2525 (i) the governing body of a municipality in
2626 which the proposed development site is to be located;
2727 (ii) subject to Subparagraph (iii), the
2828 commissioners court of a county in which the proposed development
2929 site is to be located, if the proposed site is to be located in an
3030 area of a county that is not part of a municipality; or
3131 (iii) the commissioners court of a county
3232 in which the proposed development site is to be located and the
3333 governing body of the applicable municipality, if the proposed site
3434 is to be located in the extraterritorial jurisdiction of a
3535 municipality;
3636 (C) the income levels of tenants of the
3737 development;
3838 (D) the size and quality of the units;
3939 (E) the rent levels of the units;
4040 (F) the cost of the development by square foot;
4141 (G) the services to be provided to tenants of the
4242 development;
4343 (H) whether, at the time the complete application
4444 is submitted or at any time within the two-year period preceding the
4545 date of submission, the proposed development site is located in an
4646 area declared to be a disaster under Section 418.014; and
4747 (I) quantifiable community participation with
4848 respect to the development, evaluated on the basis of written
4949 statements from any neighborhood organizations on record with the
5050 state or county in which the development is to be located and whose
5151 boundaries contain the proposed development site; [and
5252 [(J) the level of community support for the
5353 application, evaluated on the basis of a written statement from the
5454 state representative who represents the district containing the
5555 proposed development site;]
5656 (2) uses criteria imposing penalties on applicants or
5757 affiliates who have requested extensions of department deadlines
5858 relating to developments supported by housing tax credit
5959 allocations made in the application round preceding the current
6060 round or a developer or principal of the applicant that has been
6161 removed by the lender, equity provider, or limited partners for its
6262 failure to perform its obligations under the loan documents or
6363 limited partnership agreement; and
6464 (3) encourages applicants to provide free notary
6565 public service to the residents of the developments for which the
6666 allocation of housing tax credits is requested.
6767 SECTION 2. Section 2306.6718(b), Government Code, is
6868 amended to read as follows:
6969 (b) The department shall provide the elected officials with
7070 an opportunity to comment on the application during the application
7171 evaluation process [provided by Section 2306.6710] and shall
7272 consider those comments in evaluating applications [under that
7373 section].
7474 SECTION 3. Section 2306.6710(f), Government Code, is
7575 repealed.
7676 SECTION 4. The change in law made by this Act applies only
7777 to an application for a low income housing tax credit filed on or
7878 after the effective date of this Act. An application filed before
7979 the effective date of this Act is governed by the law in effect on
8080 the date the application was filed, and the former law is continued
8181 in effect for that purpose.
8282 SECTION 5. This Act takes effect September 1, 2017.
