| 7 | 7 | | relating to the composition of the State Pension Review Board. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 801.102(a), Government Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (a) The board is composed of nine [seven] members. |
|---|
| 12 | 12 | | SECTION 2. Section 801.103, Government Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | Sec. 801.103. MEMBERS APPOINTED BY GOVERNOR. (a) The |
|---|
| 15 | 15 | | governor shall appoint, with the advice and consent of the senate, |
|---|
| 16 | 16 | | [seven] members to the board. |
|---|
| 17 | 17 | | (b) The governor shall appoint to the board: |
|---|
| 18 | 18 | | (1) three persons who have experience in the fields of |
|---|
| 19 | 19 | | securities investment, pension administration, or pension law but |
|---|
| 20 | 20 | | who are not members or retirees of a public retirement system; |
|---|
| 21 | 21 | | (2) one person who is a fellow of the Society of |
|---|
| 22 | 22 | | Actuaries, a member of the American Academy of Actuaries, or an |
|---|
| 23 | 23 | | enrolled actuary under the federal Employee Retirement Income |
|---|
| 24 | 24 | | Security Act of 1974 (29 U.S.C. Sec. 1001 et seq.); |
|---|
| 25 | 25 | | (3) one person who has experience in the field of |
|---|
| 26 | 26 | | governmental finance; |
|---|
| 27 | 27 | | (4) one person who is a contributing member of a public |
|---|
| 28 | 28 | | retirement system; [and] |
|---|
| 29 | 29 | | (5) one person who is receiving retirement benefits |
|---|
| 30 | 30 | | from a public retirement system; |
|---|
| 31 | 31 | | (6) one person who is selected from a list of three |
|---|
| 32 | 32 | | names submitted to the governor by the Texas State Association of |
|---|
| 33 | 33 | | Fire Fighters; and |
|---|
| 34 | 34 | | (7) one person who is selected from a list of six names |
|---|
| 35 | 35 | | submitted to the governor as follows: |
|---|
| 36 | 36 | | (A) a list of three names submitted by the Texas |
|---|
| 37 | 37 | | Municipal Police Association; and |
|---|
| 38 | 38 | | (B) a list of three names submitted by the |
|---|
| 39 | 39 | | Combined Law Enforcement Associations of Texas. |

| 40 | 40 | | SECTION 3. Section 801.106, Government Code, is amended to |
|---|
| 41 | 41 | | read as follows: |
|---|
| 42 | 42 | | Sec. 801.106. TERMS OF OFFICE. Members of the board hold |
|---|
| 43 | 43 | | office for staggered terms of six years, with the terms of [two or] |
|---|
| 44 | 44 | | three members[, as appropriate,] expiring on January 31 of each |
|---|
| 45 | 45 | | odd-numbered year. |
|---|
| 46 | 46 | | SECTION 4. As soon as practicable after the effective date |
|---|
| 47 | 47 | | of this Act, the governor shall appoint the two additional members |
|---|
| 48 | 48 | | to the State Pension Review Board from lists provided to the |
|---|
| 49 | 49 | | governor as required by Section 801.103, Government Code, as |
|---|
| 50 | 50 | | amended by this Act. Notwithstanding Section 801.106, Government |
|---|
| 51 | 51 | | Code, as amended by this Act, the members appointed under this |
|---|
| 52 | 52 | | section serve terms expiring January 31, 2023. |
|---|
| 53 | 53 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 57 | 57 | | Act takes effect September 1, 2017. |
