55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the State Pension Review Board.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 801.102(a), Government Code, is amended
1010 to read as follows:
1111 (a) The board is composed of nine [seven] members.
1212 SECTION 2. Section 801.103, Government Code, is amended to
1313 read as follows:
1414 Sec. 801.103. MEMBERS APPOINTED BY GOVERNOR. (a) The
1515 governor shall appoint, with the advice and consent of the senate,
1616 [seven] members to the board.
1717 (b) The governor shall appoint to the board:
1818 (1) three persons who have experience in the fields of
1919 securities investment, pension administration, or pension law but
2020 who are not members or retirees of a public retirement system;
2121 (2) one person who is a fellow of the Society of
2222 Actuaries, a member of the American Academy of Actuaries, or an
2323 enrolled actuary under the federal Employee Retirement Income
2424 Security Act of 1974 (29 U.S.C. Sec. 1001 et seq.);
2525 (3) one person who has experience in the field of
2626 governmental finance;
2727 (4) one person who is a contributing member of a public
2828 retirement system; [and]
2929 (5) one person who is receiving retirement benefits
3030 from a public retirement system;
3131 (6) one person who is selected from a list of three
3232 names submitted to the governor by the Texas State Association of
3333 Fire Fighters; and
3434 (7) one person who is selected from a list of six names
3535 submitted to the governor as follows:
3636 (A) a list of three names submitted by the Texas
3737 Municipal Police Association; and
3838 (B) a list of three names submitted by the
3939 Combined Law Enforcement Associations of Texas.
4040 SECTION 3. Section 801.106, Government Code, is amended to
4141 read as follows:
4242 Sec. 801.106. TERMS OF OFFICE. Members of the board hold
4343 office for staggered terms of six years, with the terms of [two or]
4444 three members[, as appropriate,] expiring on January 31 of each
4545 odd-numbered year.
4646 SECTION 4. As soon as practicable after the effective date
4747 of this Act, the governor shall appoint the two additional members
4848 to the State Pension Review Board from lists provided to the
4949 governor as required by Section 801.103, Government Code, as
5050 amended by this Act. Notwithstanding Section 801.106, Government
5151 Code, as amended by this Act, the members appointed under this
5252 section serve terms expiring January 31, 2023.
5353 SECTION 5. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2017.
