55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study regarding the appointment and use of attorneys
88 ad litem in cases involving the Department of Family and Protective
99 Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) In this section:
1212 (1) "Attorney ad litem" has the meaning assigned by
1313 Section 107.001, Family Code.
1414 (2) "Commission" means the Permanent Judicial
1515 Commission for Children, Youth and Families established by the
1616 supreme court.
1717 (b) The commission shall study the appointment and use of
1818 attorneys ad litem in cases involving the Department of Family and
1919 Protective Services. The commission shall:
2020 (1) examine:
2121 (A) the method for appointing attorneys ad litem;
2222 (B) the oversight and accountability measures
2323 used across the state to monitor attorneys ad litem;
2424 (C) the methods by which qualifications for
2525 appointment as an attorney ad litem and training requirements for
2626 an attorney ad litem are established and enforced;
2727 (D) the timing of and duration of appointments;
2828 (E) the rate of compensation for appointments and
2929 the method for establishing compensation rates across the state;
3030 (F) the quality of representation and methods for
3131 assessing performance of attorneys ad litem;
3232 (G) the pretrial and posttrial client
3333 satisfaction with representation by attorneys ad litem
3434 representing parents and attorneys ad litem representing children;
3535 (H) organizational studies and national
3636 standards related to the workload of attorneys ad litem;
3737 (I) the best practices for attorneys ad litem;
3838 and
3939 (J) the estimated and average costs associated
4040 with legal representation by an attorney ad litem per child
4141 compared with the costs associated with foster care per child;
4242 (2) conduct a survey of attorneys ad litem about the
4343 attorney's training, including:
4444 (A) the attorney's legal education;
4545 (B) whether the attorney is certified as a
4646 specialist by the Texas Board of Legal Specialization in any area of
4747 law; and
4848 (C) the professional standards followed by the
4949 attorney;
5050 (3) perform a statistical analysis of the data and
5151 information collected under Subdivisions (1) and (2) of this
5252 subsection; and
5353 (4) develop policy recommendations for improving the
5454 attorney ad litem appointment process.
5555 (c) The commission shall prepare a report based on the
5656 findings of the study conducted under this section and shall submit
5757 the report to each member of the legislature not later than
5858 September 1, 2018.
5959 SECTION 2. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2017.
