A BILL TO BE ENTITLED
AN ACT
relating to export fees charged by the Middle Pecos Groundwater
Conservation District; changing a fee.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 8851.104(b), Special District Local Laws
Code, is amended to read as follows:
(b) In addition to other fees assessed by the district, the
district may assess a fee on groundwater transferred out of the
district in accordance with Section 36.122(e)(1) or (2), Water
Code, in an amount not to exceed 10 percent of the amount of the fee
assessed for the production of water for use in the district if a
production fee is assessed.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2017.
