55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disqualification of directors of the Middle Pecos
88 Groundwater Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 8851, Special District
1111 Local Laws Code, is amended by adding Section 8851.0545 to read as
1212 follows:
1313 Sec. 8851.0545. DISQUALIFICATION OF DIRECTORS. The board
1414 by unanimous vote of the board's remaining directors may remove a
1515 director only if that director has missed one-half or more of the
1616 regular meetings scheduled during the prior 12 months.
1717 SECTION 2. (a) The legal notice of the intention to
1818 introduce this Act, setting forth the general substance of this
1919 Act, has been published as provided by law, and the notice and a
2020 copy of this Act have been furnished to all persons, agencies,
2121 officials, or entities to which they are required to be furnished
2222 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
2323 Government Code.
2424 (b) The governor, one of the required recipients, has
2525 submitted the notice and Act to the Texas Commission on
2626 Environmental Quality.
2727 (c) The Texas Commission on Environmental Quality has filed
2828 its recommendations relating to this Act with the governor, the
2929 lieutenant governor, and the speaker of the house of
3030 representatives within the required time.
3131 (d) All requirements of the constitution and laws of this
3232 state and the rules and procedures of the legislature with respect
3333 to the notice, introduction, and passage of this Act are fulfilled
3434 and accomplished.
3535 SECTION 3. This Act takes effect September 1, 2017.
